About approval of the Procedure for licensing of transportation of the radioactive materials or devices containing radioactive materials and forms of the license

1. Approve:

1) procedure for licensing of transportation of the radioactive materials or devices containing radioactive materials according to Appendix No. 1;

2) form of the license for transportation of the radioactive materials or devices containing radioactive materials according to Appendix No. 2.

2. This Resolution becomes effective for the tenth day after its official publication.

Procedure for licensing of transportation of the radioactive materials or devices containing radioactive materials

1. General provisions

1. This Procedure establishes requirements imposed to licensing of transportation of the radioactive materials or devices containing radioactive materials in the Republic of Armenia.

2. The license for transportation of the radioactive materials or devices containing radioactive materials is issued by regulating authority in the field of use by atomic energy (further - regulating authority).

3. This Procedure is developed according to requirements of the Laws of the Republic of Armenia "About licensing" and "About safe use of atomic energy in the peace purposes" and standards of safety of International Atomic Energy Agency.

4. Provisions of this Procedure extend to radioactive materials or devices, containing radioactive materials, with the characteristics equal to levels of release from the regulating control (further - release level) or exceeding them.

Levels of release of the transported radioactive materials or devices containing radioactive materials are established on regulations of beam safety.

5. For transportation of the radioactive materials or devices containing radioactive materials with characteristics lower than the levels of release the license is not required.

2. Documents necessary for receipt of the license, and mandatory requirements

For receipt of the license for transportation of the radioactive materials or devices containing radioactive materials the application according to form in which are specified the name, number of state registration of the legal entity, the place of implementation of activities, the location, what types of the radioactive materials or devices containing radioactive materials is submitted to regulating authority is going to use, the field of use.

6.1. For licensing the state fee according to the procedure and the size, established by the Law of the Republic of Armenia "About the state fee" is collected. At the same time:

1) the licensing body during one worker for later decision making about licensing or its duplicate, prolongation of effective period of the license, renewal of the license, occupation the same activities which are subject to licensing and in other place properly informs on it the applicant. The applicant shall be warned by informing about the effects provided by subitem 4 of this Item;

2) the applicant shall pay the state fee established by the Law for the related activity established by subitem 1 of this Item no later than within five working days after licensing or its duplicate, prolongation of effective period of the license, renewal of the license, satisfaction of the request about occupation the same activities which are subject to licensing and in other place;

3) the applicant can not submit the document confirming payment of the state fee to authorized body. In case of non-presentation by the applicant of the document confirming payment of the state fee, the licensing body after decision making about licensing or its duplicate prolongation of effective period of the license, renewal of the license, occupation the same activities which are subject to licensing and in other place by means of system of treasurer network management or electronic system of the state payments certifies about payment of the state fee and hands or sends to the applicant properly the license, the duplicate of the license, the license with prolonged term, the renewed license, the license for occupation the same activities which are subject to licensing and in other place, and also relevant decisions about it;

4) in case of failure to pay the state fee by the applicant in time, provided by subitem 2 of this Item, the corresponding request is rejected based on failure to pay the state fee. After request variation the decision of licensed body is nullified.

7. Shall be applied to the request:

a) ceased to be valid

b) the detailed description of the used vehicles;

c) ceased to be valid

d) e) the receipt on payment of the state fee or the receipt generated by electronic system of the state payments or 20-unit code of the receipt in case of preliminary payment (it is represented at the request of the applicant);

e) for radioactive materials of the first, second and third class - plans of physical protection and emergency reaction;

g) the conclusion about examination of the document specified in the subitem "e" of this Item.

8. Transportation of the radioactive materials and devices containing radioactive materials shall be performed according to requirements of the Order of the Government of the Republic of Armenia of June 27, 2002 No. 931-N "About approval of procedure for safe transportation of nuclear and radioactive materials".
