I ORDER:

1. Approve the Instruction about order of registration of prints of marks - the special signs certifying manufacturers of jewelry and household products from precious metals that is applied.

2. Declare invalid the order of the Ministry of Finance of Ukraine of July 14, 1999 No. 168 "About approval of the Instruction about order of registration in the Public assay service of prints of special signs - marks of manufacturers of jewelry and household products from precious metals", registered in the Ministry of Justice of Ukraine on August 6, 1999, No. 537/3830.

3. (Nazimok M. M.) to provide to the public assay service provision of this order on state registration in the Ministry of Justice of Ukraine according to the procedure, established by the current legislation.

4. To impose control of execution of this order on the chairman of the Public assay service Nazimk M. M.

5. This order becomes effective in 10 days after state registration in the Ministry of Justice of Ukraine.

The instruction about order of registration of prints of marks of the special signs certifying manufacturers of jewelry and household products from precious metals

1. General provisions

1.1. This Instruction is developed according to the Law of Ukraine "About state regulation of production, production and use of precious metals and gemstones and control of transactions with them", the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375.

1.2. Requirements of the Instruction are obligatory for legal entities and physical persons (business entities) which perform production of jewelry and household products from precious metals.

1.3. In this Instruction terms and concepts are used in such value:

- the manufacturer - business entities of all forms which make or plan to make jewelry and household products of precious metals;

- products from precious metal - any jewelry and household products made from alloys of precious metals - gold, silver, platinum, palladium;

the paragraph the fourth is excluded;

- mark - the special sign certifying the manufacturer of jewelry and household products from precious metals.

1.4. The instruction introduces single requirements to form and content of mark (marks), and also to conditions and procedure for assignment of individual signs (code) to the manufacturer and registration of print of mark (marks) in the Ministry of Finance of Ukraine.

1.5. Business entities (manufacturers) which produce products from precious metals shall have noun which print is put down by the manufacturer on all products.

1.6. The print of mark (marks) annually is subject to registration in the Ministry of Finance of Ukraine. Use mark (marks) which print (which) it is not registered in the Ministry of Finance of Ukraine is forbidden.

1.7. The single database about prints of marks is created and kept the Ministry of Finance of Ukraine.

2. Requirements to marks and their prints

2.1. Marks shall meet for form, system of designation of year of use, individual signs (code) of the manufacturer the requirements established by the Ministry of Finance of Ukraine according to appendix 1.

2.2. The mark (marks) in case of production, use, storage and destruction is subject to strict accounting. Business entities determine persons who bear the personal responsibility for observance of the established requirements to production, use, accounting, storage and destruction of mark.

2.3. It is forbidden to use mark which print is registered the current year, next year.

2.4. The mark print on products from precious metals shall be relief and accurate (not deformed), with reproduction of form of mark and all information signs. In case of zashlifovka or deformation of print of mark the new print is applied on products.

2.5. The print of mark is applied on the main part of product to one of methods: mechanical (method of mechanical blow), electroerosive, laser.

2.6. If owing to considerable deformation the mark is out of service, another is made - with similar information signs. The print of new mark is sent to registration to the Ministry of Finance of Ukraine and applied to earlier registered.

2.7. Marks which owing to use within year wore out (were deformed), are liable to destruction. Marks which term of use ended are liable to destruction till January 20 of the next year.

2.8. Destruction of mark (marks) is performed by the manufacturer of products from precious metals C the owner of mark (marks) about what the statement of destruction is drawn up. Before destruction of mark (marks) its print (their prints) is applied on brass or copper plate. The plate is stored at the manufacturer.

2.9. Manufacturers of products from precious metals (taking into account self-produced features) develop the internal instruction about procedure for production, use, accounting, storage and destruction of marks.

3. Order of registration of prints of marks

3.1. Prints of all made marks which are provided to be used within year are subject to registration. For registration of print of mark (marks) the manufacturer submits the application of the established form to the Ministry of Finance of Ukraine (appendix 2).

3.2. Based on the statement and the documents Ministry of Finance of Ukraine attached to it appropriates to the manufacturer individual signs (code), approves form and conventional signs of mark (marks) according to appendix 1.

3.3. Registration of print of mark (marks) is performed after provision of registration cards by the manufacturer (in duplicate) with prints of the made marks.
