About application of the Law of the Azerbaijan Republic "About lease of land"

Due to the entry into force of the Law of the Azerbaijan Republic "About lease of land", for the purpose of ensuring application of this law I decide:

1. Charge to the Cabinet of Ministers of the Azerbaijan Republic within a month:

- provide to the President of the Azerbaijan Republic offers on reduction of the existing legal acts to compliance with the Law of the Azerbaijan Republic "About lease of land";

- prepare and submit for approval of the President of the Azerbaijan Republic the draft of rules of carrying out the land tenders and biddings connected with transfer to lease of the lands provided in the ninth part of article 10th of this Law;

- prepare and provide to the President of the Azerbaijan Republic the draft of the legal act determining types of responsibility for violation of the Law of the Azerbaijan Republic "About lease of land";

- provide reduction of regulatory legal acts of the Cabinet of Ministers and the relevant central executive bodies in compliance with this Law and inform on it the President of the Azerbaijan Republic;

- within the powers to resolve other issues following from the Law of the Azerbaijan Republic "About lease of land".

2. Determine that:

2.1. powers of the "relevant organ of the executive authority" provided in the ninth part of Article 10, the first offer of Article 10-1.1 (in both cases), the first offer of Articles 10-1.2. 4, 10-1.3, 10-1.3.2, 10-1.4, first and second offer of Article 10-1. 5, Articles 10-1.6 (in both cases), 10-1.7, 10-1,8 and 10-1,9 of the Law of the Azerbaijan Republic "About lease of land", is performed by the President of the Azerbaijan Republic;

2.1-1. in article 10-1.8 of this Law "body (organization)" means the President of the Azerbaijan Republic;

2.2. powers of the "relevant organ of the executive authority" provided in the fifth part of article 14th of this Law are performed by the Cabinet of Ministers of the Azerbaijan Republic;

2.3. the powers of "relevant organ of the executive authority" provided by part two of article 10 of this Law are performed by the Ministry of Ecology and Natural Resources of the Azerbaijan Republic, and in other cases are performed - the Ministry of Economics of the Azerbaijan Republic as Public service on property questions of the Azerbaijan Republic;

2.3-1. powers of the relevant organ of the executive authority provided by the second offer of part six of article 10 of this Law as Public service on property questions are performed by the Ministry of Economics of the Azerbaijan Republic;

2.4. the powers of relevant organs of the executive authority provided by part five of Article 10 and part two of article 18 of this law extend to the lands belonging to the state being in use of the legal entities who are in state-owned property or on lands on which the construction of the state objects is designed and also on lands on which the companies and objects constructed by legal entities and physical persons are located (the industrial parks or science and technology parks, industrial districts and agroparks created by the state, the Ministry of Economics of the Azerbaijan Republic as a part of Public service concerning property of the Azerbaijan Republic concerning provision in lease of the artificial parcel of land created on the site of the Caspian Sea (lake) belonging to the Azerbaijan Republic, except for the parcels of land which are in state-owned property intended for the tourist centers in borders of zones of tourism and recreation), concerning the lands which are in limits of the site of the Caspian Sea (lake) relating to the Azerbaijan Republic, provided by the paragraph the fourth parts one of article 5 of this law (according to the offer of the Ministry of Ecology and Natural Resources of the Azerbaijan Republic), and along the coast of 20-50-meter coastal strip - the Cabinet of Ministers of the Azerbaijan Republic, and concerning other lands provided by this Article - district (city) executive bodies;

2.5. Powers of relevant organ of the executive authority, stipulated in Item to the ninth article 14 of the specified Law, concerning the lands used by legal entities of state-owned property or on which the construction of the state objects, and also lands of state-owned property on which the companies and objects constructed by legal entities and physical persons are located were designed, privatized are performed by the Ministry of Economics of the Azerbaijan Republic as Public service on property questions, and concerning other lands of state-owned property - the Ministry of Economics of the Azerbaijan Republic as the State Tax Administration;

2.6. in articles 10-1.2.4 and 10-1.9 of the Law "the body (structure)" is meant as the Cabinet of Ministers of the Azerbaijan Republic;

2.7. In article 10-1.3.2 of this Law, in the first and second offers of Article 10-1. 5, in Article 10-1.6 (in the first case) "the body (organization)" means the Ministry of Agriculture of the Azerbaijan Republic. (concerning the parcels of land leased for the agricultural purposes) and the Ministry of Economics of the Azerbaijan Republic on behalf of Public service on property questions (concerning the parcels of land leased for the agricultural and nonagricultural purposes);

2.8. under "body (structure)" in the first offer of Article 10-1.1 (in the first case), Article 10-1. 3, first offer of Article 10-1. 4, Articles 10-1.6 (in the second case) and 10-1.7 these Laws are implied district (city) executive bodies;

2.9. in the first offer of article 10-1.1 of this Law (in the second case) "the body (organization)" means the Ministry of Agriculture of the Azerbaijan Republic;

2.10. In the first offer of article 10-1.1 of this Law (in the first case) "information system" means the information system "Electronic Agricultural Industry".

3. This Decree becomes effective from the date of publication.
