1. Approve the enclosed Rules of holding open tender by determination of the registrar of grain receipts.

2. To provide to department of production and conversion of crop products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within 10 (ten) calendar days from the date of the state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within 10 (ten) calendar days after the state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan;

5) within 10 (ten) working days after the state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after 21 (twenty one) calendar days after day of its first official publication.

Rules of holding open tender by determination of the registrar of grain receipts

Chapter 1. General provisions

1. Rules of holding open tender by determination of the registrar of grain receipts (further - Rules) are developed according to subitem 32-5) of article 6 of the Law of the Republic of Kazakhstan of January 19, 2001 "About grain" (further - the Law on grain) and determine procedure for the organization and holding open tender by determination of the registrar of grain receipts (further - the registrar).

2. In these rules the following concepts are used:

1) information system of grain receipts (further - information system) - the automated system of maintaining the state electronic register of holders of grain receipts intended for storage, processing, search, distribution, transfer and providing information on grain receipts and their holders;

2) the grain receipt - the warehouse certificate in the form of bank not issued security, the confirmatory property right to certain amount of grain;

3) the potential supplier of services of the registrar (further - the supplier) - the legal entity participating in open tender by determination of the registrar and applying for determination by his registrar;

4) authorized body - the central executive body performing coordination and regulation of activities of participants of the grain market within competence.

Chapter 2. Procedure for determination of open tender by determination of the registrar

4. Commission chairman:

5. Secretary of the commission:

1) creates the agenda of commission session, provides the commission with necessary documents, will organize carrying out commission session;

Draws up 2) and signs with members of the commission the protocol of opening of envelopes with proposals of suppliers, the protocol on results of open tender by determination of the registrar;

3) ensures safety of documents and materials by determination of the registrar from the moment of opening of proposals of suppliers;

4) at least in fifteen calendar days prior to final date of providing of offers by suppliers is provided by publication on Internet resource of authorized body of the notice on holding open tender by determination of the registrar (further - tender).

6. For participation in open tender the supplier shall conform to the requirements provided in appendix 1 to these rules.

7. Acceptance of offers from suppliers is performed by authorized body within fifteen calendar days from the moment of publication of the notice.

8. The document package represented by the supplier for participation in tender contains:

1) the statement signed by the first head of the supplier on participation in tender in form according to appendix 2 to these rules;

2) the notarized copy of the charter (in case of its availability) approved in the procedure established by the legislation, except as specified, when the legal entity performs activities based on the Standard charter approved by the order of the Minister of Justice of the Republic of Kazakhstan of February 24, 2015 No. 106 "About approval of standard charters of the legal entities belonging to subjects of small, medium and big business" (further - the Standard charter) (it is registered in the Register of the state registration of regulatory legal acts at No. 10563);

3) notarized copies of documents on information system which owner is the supplier:

the act of input in commercial operation of information system;

the act of testing with positive result of testing of information system for compliance to requirements of information security;

the protocol of examination of program documentation on information system;

certificate of compliance of information system to requirements of information security;
