About approval of the Regulations on procedure for provision of lump sum payment in case of the child's birth "balaga to suyunch"

1. Approve Regulations on procedure for provision of lump sum payment in case of the child's birth "balaga to suyunch" according to appendix.

2. Determine that:

- the amount of lump sum payment in case of the child's birth "balaga to suyunch" constitutes 4000 (four thousand) som;

- the amount of lump sum payment in case of the birth at the same time of three and more children "balaga to suyunch" constitutes 50000 (fifty thousand) som on each child;

- till July 1, 2019 the request for purpose of lump sum payment in case of the child's birth "balaga to suyunch" and its appointment are made on the basis of the joint decision of the Ministry of Labour and social development of the Kyrgyz Republic and the Public registration service under the Government of the Kyrgyz Republic about interdepartmental interaction on data exchange in electronic format within pilot project "balaga to suyunch".

3. Bring in the order of the Government of the Kyrgyz Republic "About approval of the Regulations on payment procedure of public welfare payments and monetary compensations" of December 29, 2009 No. 823 the following change:

in Regulations on the payment procedure of public welfare payments and monetary compensations approved by the above-stated resolution:

- to declare paragraph two of Item 2.1 invalid.

4. Recognize invalid:

- Items 1 and 2 of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for the address and purpose of lump sum payment in case of the child's birth - "balaga to suyunch" of December 30, 2017 No. 847;

- item 4 of the order of the Government of the Kyrgyz Republic "About implementation of the Law of the Kyrgyz Republic "About public welfare payments in the Kyrgyz Republic" of June 29, 2018 No. 307.

5. To the Ministry of Labour and social development of the Kyrgyz Republic, the Public registration service under the Government of the Kyrgyz Republic to take adequate measures for implementation of this resolution.

6. To impose control of execution of this resolution on department of social development of Government office of the Kyrgyz Republic.

7. This resolution is subject to official publication and becomes effective since April 1, 2019, except for Item 1 of this resolution which becomes effective since July 1, 2019.

Regulations on procedure for provision of lump sum payment in case of the child's birth "balaga to suyunch"

Chapter 1. General provisions

1. This Regulations on procedure for provision of lump sum payment in case of the child's birth "balaga to suyunch" (further - the Provision) determine procedure for the address, appointment and charge of lump sum payment in case of the child's birth "balaga to suyunch".

2. In this Provision the following concepts are used:

- the applicant - person who addressed for purpose of lump sum payment in case of the child's birth "balaga to suyunch" (further - lump sum payment "balaga to suyunch") on or on person which is under its guardianship, or by proxy drawn up according to requirements of the civil legislation;

- territorial authorities - territorial departments of subordinated division of the authorized state body realizing state policy in the sphere of registration of the population and civil registration;

- territorial subdivisions - territorial subdivisions of the state companies which are under authority of the authorized state body realizing state policy in the sphere of registration of the population and civil registration.

3. Lump sum payment "balaga to suyunch" is appointed in case of the request for purpose of payment in case of the child's birth, including including the child who was born at the woman who is in places of detention.

To the women who are in places of detention and not having opportunity independently to address for lump sum payment "balaga to suyunch", payment is appointed based on the address of the authorized representative who provided the power of attorney issued by administration of correctional facility, which is drawn up in accordance with the established procedure in the sphere of the civil legislation.

In case of the birth at the same time of two and more children lump sum payment "the balaga to suyunch" is appointed to each child. At the same time the separate application is submitted for each child.

4. Lump sum payment "balaga to suyunch" is not appointed to the children who died about day of the request for this payment type.

5. The amount of lump sum payment "balaga to suyunch" for persons living in the mountain and remote settlements is estimated without district coefficients.

Chapter 2. Procedure for the request for purpose of lump sum payment "balaga to suyunch"

6. The request for purpose of lump sum payment "balaga to suyunch" is made in territorial bodies / territorial subdivisions, irrespective of the country of the birth of the child, in cases when:

- parents / one of parents of the child are citizens of the Kyrgyz Republic;

- parents / one of parents of the child are persons having the status of kayrylman;

- parents / one of parents of the child are citizens of foreign state - the agreement party about guarantees of the rights of citizens in the field of payment of social benefits, compensation payments to families with children and the alimony signed on September 9, 1994 (further - the Agreement), and having the residence permit in the Kyrgyz Republic.
