About the organization and functioning of the Inspectorate of operational management of the Ministry of Internal Affairs

Based on Items b) and e) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412) and parts (1) article 15 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537) DECIDES: the Government

1. Approve according to the offer of the Ministry of Internal Affairs creation of the Inspectorate of operational management - the administrative authority subordinated to the Ministry of Internal Affairs, with form of business of inspectorate, based on Service of operation management and inspection (structure without the status of the legal entity), subordinated to the Ministry of Internal Affairs.

2. The inspectorate of operational management of the Ministry of Internal Affairs is legal successor of the rights and obligations of Service of operation management and inspection of the Ministry of Internal Affairs.

3. To transfer the property, established posts established in the staff list and the budget for 2019 of Service of operation management and inspection of the Ministry of Internal Affairs to the Inspectorate of operational management.

4. Establish the extreme number of staff of the Inspectorate of operational management in number of 43 units from which 38 government employees with special status and 5 units of government employees, with the annual salary fund according to the legislation.

5. Approve:

1) Regulations on the organization and functioning of the Inspectorate of operational management, according to appendix No. 1;

2) structure of the Inspectorate of operational management, according to appendix No. 2;

3) to organigramm of the Inspectorate of operational management, according to appendix No. 3;

4) changes which are made to some orders of the Government, according to appendix No. 4.

6. To the Ministry of Internal Affairs:

To provide 1) to the Inspectorate of operational management of the room and the corresponding material and technical resources for the purpose of ensuring accomplishment of the obligations;

2) to provide the translation of 8 state positions with special status from the General inspectorate of police of the Ministry of Internal Affairs and 6 state positions with special status from the Service of information technologies subordinated to the Ministry of Internal Affairs, in the Inspectorate of operational management subordinated to the Ministry of Internal Affairs;

3) to bring the regulations into accord with this resolution.

7. To the agency of the state services, at the request of the owner to make necessary changes to cadastral documents.

8. To impose control of execution of this resolution on the Ministry of Internal Affairs.

9. This resolution becomes effective from the date of publication.

Changes which are made to some orders of the Government

1. In part II of the Section II of appendix No. 1 to the Order of the Government No. 1001/2011 on enforcement of provisions of some legal acts (The official monitor of the Republic of Moldova, 2011, Art. No. 238-242, 1100) d letter) to add with Item 6 of the following content:

"6. Inspectorate of operational management".

2. In Item 2 of the Order of the Government No. 986/2012 on structure and extreme number of the General inspectorate of police (2012, Art. No. 273-279, 1064) figures "9231" and "2611" to replace the official monitor of the Republic of Moldova with figures "9223" and, respectively, "2603".

3. In Item 2 of the Order of the Government No. 754/2014 on approval of the Regulations on the organization and functioning of the Service of information technologies subordinated to the Ministry of Internal Affairs, its structure and extreme number (2014, Art. No. 275-281, 804) figures "120" to replace the official monitor of the Republic of Moldova with figures "114".

4. The table of appendix No. 5 to the Order of the Government No. 460/2017 about enforcement of provisions of the Law on the government employee with special status of the Ministry of Internal Affairs No. 288/2016 (2017, Art. No. 214-215, 538) to add the official monitor of the Republic of Moldova with line item of the following content:

"Chief Inspektorata of operational management

- accepts / appoints to work and dismisses, raises, recalls, makes the decision on ensuring temporary execution of the leading state position with special status, prolongs stay term on service over age limit according to legislation provisions, makes the decision on lowering in rank and recovery of special rank, on sending to official journey, on discharge from position, on reinstatement, appoints encouragement and imposes authority punishments on government employees with special status of Inspektorat of operational management, except for positions of the deputy chief Inspektorat of operational management;

- grants annual paid leaves, social and educational leaves to all list of subordinate government employees with special status;

- issues the order on creation, the organization and functioning of the Commission on consideration of the applications on recognition of activities in civil areas, related - appropriates specialties (position) occupied in the Inspectorate of operational management to government employees with the special status which is in the service in the Inspectorate of operational management, special ranks to the commissioner's rank inclusive".
