ORDER OF THE MINISTER OF NATIONAL ECONOMY OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public

According to the subitem 1) article 17-1 of the Law of the Republic of Kazakhstan of December 19, 2003 "About advertizing" PRIKAZYVAYU:

1. Approve the enclosed Rules of placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public.

2. To provide to development department of entrepreneurship in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order its direction in paper and electronic form in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Rules of placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public

Chapter 1. General provisions

1. These rules of placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public (further - Rules) are developed according to the subitem 1) of article 17-1 of the Law of the Republic of Kazakhstan of December 19, 2003 "About advertizing".

2. Rules determine procedure for placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public.

3. In these rules the following basic concepts are used:

1) advertizing - the information distributed and (or) placed in any form by means of any means, intended for the indefinite group of people and designed to create or maintain interest in physical person or legal entity, goods, trademarks, works, services and to promote their realization;

2) the advertizing distributor - the physical person or legal entity performing distribution and placement of the ad info by provision and (or) uses of property, including technical means of TV and radio broadcasting and different ways;

3) sign - information on the name and kind of activity of physical persons and legal entities, including means of their individualization, placed within input to the building on number of inputs in it and (or) on input of barrier of the occupied territory, and also roofs and facades within buildings, extensions to them and shoddy constructions of physical persons and legal entities in places of their actual stay and sales of goods, performance of works and rendering services;

4) outdoor (visual) advertizing - the advertizing placed on objects of outdoor (visual) advertizing and available to visual acceptability on open space outside rooms in settlements, in band of withdrawal of highways public on open space outside rooms out of settlements and out of band of withdrawal of highways public;

5) object of outdoor (visual) advertizing - construction, different volume or sheet constructions, including screens and electronic boards, light constructions, and other means used for distribution and (or) advertizing;

6) local executive body - the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

7) street furniture (equipment) - the objects of decorative nature and practical use (flower vases, pavilions, arbors, benches, ballot boxes, public transport stops, data panel, the equipment and constructions for games of children and rest of adult population) established in settlements on open space outside rooms.

Other concepts and terms used in these rules are applied according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for placement of outdoor (visual) advertizing on open space outside rooms in settlements, in band of withdrawal of highways public, on open space outside rooms out of settlements and out of band of withdrawal of highways public

4. Placement of outdoor (visual) advertizing is performed by display and drawing advertizing images and (or) information on the objects of outdoor (visual) advertizing including placed on outer sides of buildings (constructions).

5. Advertizing images and (or) information on objects of outdoor (visual) advertizing shall not be used for promotion or propaganda of violent change of the constitutional system, violation of integrity of the Republic of Kazakhstan, undermining safety of the state, war, social, racial, national, religious, class and patrimonial superiority, cult of cruelty and violence, pornography, and also distribution of the data constituting the state secrets of the Republic of Kazakhstan and other secrets protected by the law.

6. Advertizing shall not discredit the objects of art constituting world or national cultural property, the state characters (the coats of arms, flags, anthems), currency of any state, religious characters, any physical persons or legal entities, activities, profession and goods.
