About some questions of the Security Council of the Republic of Kazakhstan

According to the subitem 20) article 44 of the Constitution of the Republic of Kazakhstan, the constitutional laws of the Republic of Kazakhstan "About the President of the Republic of Kazakhstan", "About the First President of the Republic of Kazakhstan - Elbasa" and the Law of the Republic of Kazakhstan "About the Security Council of the Republic of Kazakhstan" POSTANOVLYAYU:

1. Approve Regulations on the Security Council of the Republic of Kazakhstan (appendix 1).

2. Administration of the President of the Republic of Kazakhstan together with the Government of the Republic of Kazakhstan within two months to take measures for implementation of this Decree.

3. Recognize invalid some acts of the President of the Republic of Kazakhstan according to appendix 2 to this Decree.

4. Make changes to some acts of the President of the Republic of Kazakhstan according to appendix 3 to this Decree.

5. To impose control of execution of this Decree on Administration of the President of the Republic of Kazakhstan.

6. This Decree becomes effective from the date of signing.

Regulations on the Security Council of the Republic of Kazakhstan

1. General provisions

1. The Security Council of the Republic of Kazakhstan (further - the Security Council) is the constitutional body formed by the President of the Republic of Kazakhstan and coordinating carrying out single state policy in the sphere of ensuring national security and defense capability of the Republic of Kazakhstan for the purpose of preserving internal political stability, protection of the constitutional system, the state independence, territorial integrity and national interests of Kazakhstan on the international scene.

2. The Security Council is headed by the First President of the Republic of Kazakhstan - Elbasa which owing to its historical mission as to the founder of Independent Kazakhstan for life possesses the right to head the Security Council as the Chairman.

The legal basis of activities of the Security Council the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About the Security Council of the Republic of Kazakhstan" constitute, other regulatory legal acts of the Republic of Kazakhstan and the international agreements of the Republic of Kazakhstan, and also this Provision.

2. Tasks and functions of the Security Council

4. The main objectives of the Security Council are:

1) introduction of offers and recommendations to the President on realization of the main directions of state policy in the field of ensuring national security, strengthening of defense capability of the country, law enforcement and law and order, coordination of activities of state bodies and the organizations in these spheres;

2) development of drafts of decisions for the President on:

to introduction, prolongation, cancellation of warlike situation;

to introduction, prolongation, cancellation of emergency state;

to use of Armed Forces of the Republic of Kazakhstan for accomplishment of the international obligations on peacekeeping and safety;

3) other tasks according to the legislation of the Republic of Kazakhstan and decisions of the President of the Security Council.

5. Functions of the Security Council are:

1) coordination of activities of law enforcement and special state bodies for the purpose of ensuring national security and implementation of decisions of the Security Council;

2) monitoring and assessment of condition of execution of strategic documents of the state in the most important directions of development of the country;

3) the complex analysis and assessment of state programs, bills, important foreign policy and other state and significant initiatives, and also development of the situation in the country, world and regional tendencies, forecasting of internal and external threats of national security, development of offers and determination of measures for their prevention and neutralization;

4) hearing of the annual report of the Government of the Republic of Kazakhstan on results and the main activities in the sphere of ensuring national security, defense capability of the country, law and order;

5) hearing of the first heads of state bodies concerning realization of state policy in the sphere of ensuring national security and defense capability of the country;

6) discussion of the candidates recommended for appointment as the President to positions of the first heads of the central and local executive bodies of areas, the cities of republican value and the capital, and also state bodies directly subordinate and accountable to the President;

7) the analysis, monitoring, inspection of activities of law enforcement agencies, Armed Forces, other troops and military forming, coordination of activities of state bodies and organizations for implementation of actions in the sphere of ensuring national security and the international line items of the country, defense capability of the state, legality and law and order;

8) development of offers on ensuring protection of the constitutional system, the state sovereignty and territorial integrity of the Republic of Kazakhstan, preparation of drafts of decisions of the President concerning safety of the personality, society and the state;

9) the analysis of results of control of target use of the funds of the republican budget allocated for defense, public order and safety;

10) the analysis of bills on national security issues, submission of recommendations about them to the President;

11) coordination of drafts of presidential decrees about introduction of military, extraordinary provisions, appeals of the President to Parliament of the Republic of Kazakhstan about use of Armed Forces for accomplishment of the international obligations on peacekeeping and safety;

12) other functions according to the legislation of the Republic of Kazakhstan.
