About establishment of exceptions and (or) features of introduction of deadlines of calculations for transactions of export and commodity import and modification of some regulatory legal acts

According to Articles 6, of 7, of 15, of 25, of 44, 56 Laws of Ukraine "About the National Bank of Ukraine", article 13 of the Law of Ukraine "About currency and currency transactions", to the order of the Cabinet of Ministers of Ukraine of February 13, 2019 No. 76-r "About approval of the inventory and (or) industries of economy for which the National Bank has the right to establish exceptions and (or) features of the implementation of measures of protection provided by paragraph one of part one of article 13 of the Law of Ukraine "About the currency and currency transactions"", for the purpose of settlement of procedure by banks of currency supervision of observance by residents established by the National Bank of Ukraine of deadlines of calculations for transactions for export and commodity import Board of the National Bank of Ukraine DECIDES:

1. Determine that deadlines of the calculations for transactions on export and commodity import determined in Item 21 of the Section II of Provisions on measures of protection and determinations of procedure for the making of separate foreign currency transactions approved by the resolution of Board of the National Bank of Ukraine of January 2, 2019 No. 5 and in Item 14-2 of the resolution of Board of the National Bank of Ukraine of February 24, 2022 No. 18 "About work of bank system during introduction of warlike situation" (with changes), do not extend on:

1) goods which are used for performance of works on production (development) of aggregates, systems of space missile systems (space carrier rockets), spacecrafts, land segment of space systems and their aggregates, systems and components, and also on development, production, re-equipment, repair, modification, maintenance of the aircraft equipment and aviation engines for the subjects of space activities determined according to article 1 of the Law of Ukraine "About space activities" and also the subjects of aircraft construction falling under operation of article 2 of the Law of Ukraine "About development of the aircraft constructing industry";

2) goods which are exported or imported for needs of the agreement on distribution of products and are provided by such agreement;

3) goods which import is performed within accomplishment of public contracts (agreements) according to the approved main indicators of the defensive order for 2020 and 2021;

4) the goods and services which are subject to purchase according to the purchase agreements signed by the Ministry of Health of Ukraine with the specialized organizations which conduct procurement, or transactions on purchase of the medicines, medical products, supportive applications and other goods of medical appointment and services concluded by the centralized purchasing organization - the state company which founder is the Ministry of Health of Ukraine;

5) services, works (except transport and insurance services and/or works), intellectual property rights and (or) other non-property rights which are exported;

6) the medical services imported for ensuring treatment (including inspections and diagnostics abroad citizens of Ukraine with diseases according to the list of the rare (orphan) diseases leading to reducing life expectancy of patients or their invalidization approved by the Ministry of Health of Ukraine and for which there are acknowledged methods of treatment;

7) the goods and services which are subject to purchase according to the agreements signed by "National Olympic Committee of Ukraine" public organization, participations of the national teams of teams of Ukraine and official delegations of Ukraine, necessary for providing, in the Olympic Games, Youth Olympic Games, the European games and other international sporting events held under the auspices of the International Olympic Committee, the European Olympic committees, Association of National Olympic Committees;

8) tourist products (services) imported according to the external economic agreements (contracts) in tourist industry - transactions on supply, realization (sale) of tourist products (services) of nonresidents by tourist operators;

9) the goods, works and services of defensive appointment which are purchased through the international specialized organizations, their representations which list is approved by the resolution of the Cabinet of Ministers of Ukraine of May 26, 2021 No. 527 "About approval of the list of the international specialized organizations, their representations conducting procurement of goods, works and services of defensive appointment";

10) goods which import is performed by the state customers in the sphere of defense within accomplishment of public contracts (contracts) for delivery (purchase) of the goods, works and services concluded according to the Laws of Ukraine "About defensive purchases" and "About public purchases" and also the resolution of the Cabinet of Ministers of Ukraine of February 28, 2022 No. 169 "Some questions of implementation of defensive and public purchases of goods, works and services in the conditions of warlike situation" (with changes);

11) military goods and double use, according to certificates of the final consumer or terms of the contract (contract) the final receiver of which are determined the law enforcement agencies, the Ministry of Defence of Ukraine, military units of the Armed Forces of Ukraine, other military forming and subjects fighting terrorism according to the law and/or participate in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation, acquired (paid) in the period of warlike situation in Ukraine;

12) goods on which are carried out and export and (or) import transactions on the external economic agreements (contracts) signed by subjects which perform activities in the sphere of use of nuclear energy, with nonresidents to whom the restrictions (moratoriums, prohibitions) established by regulatory legal acts concerning settlement of the relations with participation of faces tied with the state aggressor extend are not complete till February 24, 2022;
