About approval of the Procedure for provision and consideration of the generalized materials

1. Approve the Procedure for provision and consideration of the generalized materials which is applied.

2. Declare invalid the joint order of the Ministry of Finance of Ukraine, the Ministry of Internal Affairs of Ukraine, the Ministry of the income and charges of Ukraine, the Security Service of Ukraine of December 2, 2013 No. 1026/1184/739/484 "About approval of the Procedure for provision and consideration of the generalized materials", registered in the Ministry of Justice of Ukraine on December 23, 2013 for No. 2170/24702.

3. To submit to department of tax policy of the Ministry of Finance of Ukraine and Department of financial investigations of Public service of financial monitoring of Ukraine this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.

4. To provide to heads of the relevant structural divisions of National police of Ukraine, the Public fiscal service of Ukraine, the Security Service of Ukraine and Public service of financial monitoring of Ukraine control of execution of this order according to requirements of the legislation of Ukraine.

5. National police of Ukraine, the Public fiscal service of Ukraine, the Security Service of Ukraine to appoint authorized employees (workers) for the organization on permanent basis of interaction with Public service of financial monitoring of Ukraine in the sphere of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction.

6. This order becomes effective from the date of its official publication.

Procedure for provision and consideration of the generalized materials

I. General provisions

1. This Procedure determines form, structure, content of the generalized Gosfinmonitoring materials, and also mechanisms and system:

provisions of the generalized materials of Gosfinmonitoring of National police of Ukraine, the Security Service of Ukraine, the Public fiscal service of Ukraine (further - law enforcement agencies), to their divisions;

registration, obtaining and considerations of the generalized materials by law enforcement agencies, their divisions;

receipts by Gosfinmonitoring of information/documents on the course of study of the generalized materials by law enforcement agencies, their divisions;

prevention of disclosure of information containing in the generalized materials.

2. In this Procedure terms are used in such values:

appendices to the generalized materials - copies of documents of data on financial transactions and other information connected with the generalized materials in written and/or electronic form (in the presence);

commission of experts - the commission of Gosfinmonitoring on consideration of the generalized materials and the additional generalized materials prepared for provision to law enforcement and prospecting agencies which structure and powers affirm the separate order of Gosfinmonitoring in coordination with the Ministry of Finance of Ukraine;

provision of the generalized materials - the actions of officials of Gosfinmonitoring directed to execution of the solution of commission of experts concerning transfer, according to this Procedure, law enforcement agencies, their divisions of the generalized materials in written and/or electronic form;

predicate crime - socially dangerous illegal act which preceded legalization (washing) of income gained in the criminal way;

registration (accounting) of the generalized materials - assignment by Gosfinmonitoring to each generalized material of registration number, and also registration, registration and fixing in log books, books and the Unified register of pre-judicial investigations by law enforcement agencies and their divisions;

consideration of the generalized materials - check by implementation of operational search, counterintelligence activities and/or investigation within criminal proceedings by law enforcement agencies, their divisions of the data stated in the generalized materials and decision making according to the penal procedural legislation or other legal acts.
