About National council on human rights

(as amended on 03-05-2023)

Based on articles 2-4 of the Resolution of Parliament No. 89/2018 about approval of the National plan of action for human rights for 2018-2022 (The official monitor of the Republic of Moldova, 2018, Art. No. 295-308, 457) and for the purpose of providing the effective mechanism of development and assessment of documents the politician in the field of human rights, effective implementation of international treaties on human rights which party the Republic of Moldova is and also monitoring of accomplishment of undertaken obligations DECIDES: the Government

1. Create National council on human rights.

2. Approve:

1) structure of National council on human rights, according to appendix No. 1;

2) Regulations on National council on human rights, according to appendix No. 2;

3) Regulations on activities of the coordinator in the field of human rights, according to appendix No. 3.

3. To bodies of local public authority in 2-month time to create the municipal or district commissions on human rights protection and to inform National council on human rights on their structure.

4. Recognize invalid some orders of the Government, according to appendix No. 4.

5. This resolution becomes effective from the date of publication.

Regulations on National council on human rights

Chapter I General provisions

1. The national council on human rights (further – Council) is the consultative body of the Government created for the purpose of implementation of monitoring of procedure for implementation of state policy in the field of human rights, and also international treaties in the field of human rights which party the Republic of Moldova is.

2. The current activities of Council are provided by responsible division of the State office which performs functions of Permanent secretariat on human rights (further – Permanent secretariat). Functions of the secretary of Council are performed by person designated from among members of Permanent secretariat.

3. Bodies of the public power provide development of documents the politician in the field of human rights, reports on their implementation, reports on implementation of international treaties in the field of human rights which party the Republic of Moldova is, and about implementation of the recommendations formulated by the international mechanisms on human rights protection according to competences.

4. Bodies of the public power and public organizations give support to Council and Permanent secretariat in accomplishment of obligations and functions, including by submission of the reports provided in Item 3, and the other information necessary for implementation of their activities.

Chapter II of Power of Council

5. Council carries out the following obligations:

1) coordinating of implementation of single state policy in the field of human rights;

2) control of process of development, implementation and assessment of documents the politician in the field of human rights;

3) consideration and approval of reports about implementations of documents the politician in the field of human rights;

4) representation to the Government of the offers aimed at ensuring compliance with human rights, and also at observance of the international recommendations in this area;

5) assessment of level of respect for human rights;

6) ensuring interaction with the international mechanisms of human rights protection;

7) monitoring of activities of competent authorities of the public power and public organizations in scope of international treaties in the field of human rights which party the Republic of Moldova is;

8) creation, if necessary, ad hoc commissions and expert groups on certain directions and supervision of their work;

9) approval of reports on implementation of international treaties in the field of human rights which party the Republic of Moldova is, and the reports provided within the procedure of periodic universal assessment in the field of human rights;
