According to the subitem 38) Item 1 of article 7-1 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" and the subitem 5) article 6 of the Law of the Republic of Kazakhstan "About consumer protection" PRIKAZYVAYU:

1. Approve the enclosed Rules of maintaining the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations.

2. To provide to committee of protection of public health of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item;

6) to provide monthly placement of the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations on Internet resource of department of authorized body in the field of health care.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication.

Rules of maintaining the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations

Chapter 1. General provisions

1. These rules of maintaining the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations (further - Rules) are developed according to the subitem 38) of Item 1 of article 7-1 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" and the subitem 5) of article 6 of the Law of the Republic of Kazakhstan "About consumer protection" and determine procedure for maintaining the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations.

2. In these rules the following concepts are applied:

1) the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations (further - the Register) - the list of products, the regulatory legal acts which are not conforming to requirements in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations;

2) monitoring of safety of products - system of the actions directed to identification, the prevention and suppression of import, production, application and the sales of products which is not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations;

3) authorized body in the field of health care (further - authorized body) - the central executive body performing management and cross-industry coordination in the field of protection of public health, medical and pharmaceutical science, medical and pharmaceutical education, sanitary and epidemiologic wellbeing of the population, drug circulation and medical products, control of quality of medical services.

3. The register is kept for the purpose of informing the consumers on products representing risk for their health and the safety revealed when carrying out monitoring of safety of products.

4. The data containing in the Register are open and available to all interested persons.

Chapter 2. Procedure for maintaining the register of products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations

5. As maintaining the Register it is understood:

1) timely introduction of data on products which are not conforming to requirements of regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population, hygienic standard rates and technical regulations according to Item 6 of these rules, exception of products illegally acknowledged not corresponding, and also modification and amendments according to statements of applicants which is conducted in electronic format in the Kazakh and Russian languages;

2) placement and updating on Internet resource of department of authorized body in the field of health care (further - Department) the list of inappropriate products on monthly basis.

6. The register includes the following data by results of the Department of monitoring of safety of products which is carried out by territorial subdivisions:

1) products types according to appendix 1 to these rules;

2) product name;
