About the organization and functioning of the Agency for energy efficiency

Based on Items b) and e) article 7 of the Law on the Government No. 136/2017 (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), parts (1) article 15 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), Item h) Article 9 and Item and) parts (8) article 30 of the Law No. 139/2018 on energy efficiency (The official monitor of the Republic of Moldova, 2018, Art. No. 309-320, 476), and also the Law No. 158/2008 on the state position and the status of the government employee (The official monitor of the Republic of Moldova, 2008, Art. No. 230-232, 840) DECIDES: the Government

1. Reorganize the Agency on energy efficiency - the administrative authority subordinated to the Ministry of Economy and Infrastructure, by merging (accession) with Fund of energy efficiency.

2. The agency on energy efficiency is successor of the rights and obligations of Fund of energy efficiency.

3. Make complete cession of property of Fund of energy efficiency to the Agency on energy efficiency according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015.

4. Perform release of personnel according to the Law No. 158/2008 on the state position and the status of the government employee and the regulatory base in the field of work in case of impossibility of its translation.

5. To the Ministry of Economy and Infrastructure within 30 days from the date of publication of this resolution to create the commission on transfer of objects of public property. The commissions on transfer within 30 days from the date of creation to submit for approval to the Ministry of Economy and Infrastructure the deed of conveyance of the objects listed in Item 3.

6. Approve:

1) Regulations on the organization and functioning of the Agency on energy efficiency, according to appendix No. 1;

2) the Organizational structure of the Agency on energy efficiency, according to appendix No. 2;

3) to Organigramm Agentstva on energy efficiency, according to appendix No. 3.

7. Establish the extreme number of the Agency on energy efficiency in number of 26 units with the annual salary fund according to the regulatory base.

8. Within a month from the date of publication of this resolution to provide to the agency on energy efficiency together with Fund of energy efficiency transfer of remaining balance of financial resources of Fund of energy efficiency from the bank accounts opened at payment service providers in the government budget.

9. To the agency on energy efficiency to approve the staff list within a month and to submit it for approval to the State office.

10. In Item 2.1 of appendix to the Order of the Government No. 141/2014 on creation of system of energy statistics (The official monitor of the Republic of Moldova, 2014, Art. No. 53-59, 165) to make the following changes:

1) in letter and) the subitem 3) after the words "and renewable energy resources" to add with words ", including data on the projects financed from financial resources of the Agency on energy efficiency and/or in case of its financial support", and the subitem d) to declare invalid;

2) in b letter) the subitem 6) "funds" and "Fund of Energy Efficiency" to exclude words.

11. Recognize invalid:

2) the Order of the Government No. 401/2012 about Fund of energy efficiency (The official monitor of the Republic of Moldova, 2012, Art. No. 126-129, 448).

12. This resolution becomes effective from the date of publication.
