No. 309-320, 478) DECIDES: the Government

1. Reorganize public organization "Intervention and Payments Agency in the field of Agricultural Industry" by transformation to the "Intervention and Payments Agency in the field of Agricultural Industry" administrative authority subordinated to the Ministry of Agriculture and the food industry.

2. The "Intervention and Payments Agency in the field of Agricultural Industry" administrative authority is successor of the rights and obligations of Public organization "Intervention and Payments Agency in the field of Agricultural Industry".

3. Approve:

1) Regulations on the organization and functioning of the Agency on intervention and payments in the field of agricultural industry, according to appendix No. 1;

2) the Organizational structure of the Agency on intervention and payments in the field of agricultural industry and the List of its territorial subdivisions, according to appendix No. 2;

3) to Organigramm Agentstva on intervention and payments in the field of agricultural industry, according to appendix No. 3;

4) Changes which are made to some orders of the Government, according to appendix No. 4.

4. Establish the extreme number of personnel of the Agency on intervention and payments in the field of agricultural industry in number of 160 units.

5. Recognize invalid subitems 1) and 2) of Item 5, and also appendices No. 1 and 2 to the Order of the Government No. 521/2017 about creation of Public organization "Intervention and Payments Agency in the field of Agricultural Industry" (The official monitor of the Republic of Moldova, 2017, Art. No. 229-243, 614).

6. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry.

7. This resolution becomes effective from the date of publication.

Regulations on the organization and functioning of the Agency on intervention and payments in the field of agricultural industry

Chapter I General provisions

1. The regulations on the organization and functioning of the Agency on intervention and payments in the field of agricultural industry (further – the Provision) establish legal status, mission, the main function, powers, the rights, the organization, and also regulate activities of the Agency on intervention and payments in the field of agricultural industry (further – the Agency).

2. The agency is the administrative authority subordinated to the Ministry of Agriculture and the food industry (further – the Ministry), of National fund of development of agricultural industry and the rural circle, including the financial resources, responsible for effective management, arriving from partners in development.

3. The agency is legal entity of the public law, has own name, seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, the property management right transferred by the Ministry, and also other specific attributes of bodies of public management established by the legislation. The agency is in municipium of Chisinau.

4. The agency has the territorial subdivisions with the status of departments or services which do not have legal personality.

5. In the activities the Agency is guided by the Constitution of the Republic of Moldova and the laws of Parliament, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, other regulations, international treaties which party is the Republic of Moldova, orders of the Ministry, and also this Provision.

Chapter II Mission, main function, powers and rights of the Agency

6. The mission of the Agency consists in financial support of agricultural producers and local communities for the purpose of development of the agro-industrial sector and the rural zone.

7. The agency performs function of implementation of state policy of subsidizing and intervention of the state in the agro-industrial sector and the rural zone in the following spheres of activity:

1) stimulation of investments into agricultural holdings;

2) stimulation of investments into conversion and realization of agricultural products;

3) stimulation of investments into physical infrastructure and infrastructure of services in the rural zone;

4) providing direct payments.

8. The agency performs the following powers:

1) is provided by management of National fund of development of agricultural industry and the rural zone, and also other funds intended for support and development of the rural zone;

2) considers applications on providing subsidies, with the enclosed necessary documents, served applicants, and also establishes their acceptability for receipt of financial aid from the state;

Authorizes 3), performs and checks the direct subsidies / payments allocated from means of National fund of development of agricultural industry and the rural zone, and also from other sources of financial aid;

4) performs checks on places of investees for establishment of their acceptability;
