About measures for acceleration of development of telecommunication infrastructure in settlements of the Republic of Uzbekistan

In the country complex organizational and technical measures for upgrade and expansion of telecommunication infrastructure are implemented that allows to improve service quality and to increase types of telecommunication services, including scope by networks of mobile communication.

At the same time rates of development of telecommunication infrastructure in the remote and rural settlements, tourist and recreational areas, along trunk automobile and the railroads, and also networks of broadband wireless access to the Internet are still insufficient.

For the purpose of elimination of the negative factors influencing the accelerated development of networks of telecommunications, ensuring availability of electronic state services, and also creations of necessary infrastructure for development of digital economy in regions:

1. Determine that:

networks, constructions, means and objects of telecommunications, base stations of mobile communication of operators and providers including established in the leased territories of lessors (further - objects of telecommunications), irrespective of pattern of ownership treat objects of engineering and communication infrastructure;

the construction and acceptance in operation of public, industrial, residential, office buildings and constructions, except for buildings and constructions on which the design estimates are approved till July 1, 2019, without leading of objects of engineering and communication infrastructure, including the cable sewerage, low-current cable mines, the areas and infrastructure for placement of the telecommunication equipment is not allowed;

transfer, dismantle, and also any intervention in functioning of objects of telecommunications by the third parties is performed in the absence of other opportunities of the solution of the arisen questions and is exclusive in coordination with the owner of the specified objects. At the same time costs of operators and providers of telecommunications for work on transfer or dismantle of objects of telecommunications, their commissioning become covered in full by the initiator of these changes;

in the presence of the statement from person living in the building on provision of services of telecommunications of partnership of private homeowners also infrastructures for placement of the telecommunication equipment on a grant basis, except for mounting of base stations of mobile communication have no right to refuse or interfere with operators and providers of telecommunications in carrying out networks of telecommunications in buildings with use of low-current cable mines, areas.

2. Implement since August 1, 2019 procedure according to which:

a) are guaranteed to the providers of telecommunications who provided creation of telecommunication infrastructure for the state-financed organizations which are in the remote and rural settlements on the terms of public-private partnership, except for mobile operators within 10 years by operators:

use of their services by state-financed organizations and state unitary enterprises in the remote and rural settlements;

provision from JSC Uzbektelekom of service of Internet access in flat fares irrespective of the place of connection;

provision by state-financed organizations and state unitary enterprises in the remote and rural settlements on a grant basis the areas and infrastructure for investment of funds of the telecommunications intended for servicing of this organization and other legal entities, and also the population in this region;

b) in case of calculation of the income tax and single tax payment of operators and providers of telecommunications the taxable basis decreases by the amount of the funds allocated for creation of objects of engineering and communication infrastructure for state-financed organizations and the state unitary enterprises in the remote and rural settlements.

To the Ministry of Finance of the Republic of Uzbekistan according to requests of the state-financed organizations which are in the remote and rural settlements to allocate the funds necessary for use of telecommunication services, after their connection to networks of telecommunication.

3. Determine that regardless of capacity of signal operational collection and payment for use of radio-frequency range for wireless data transmission on Wi-fi technology in bands of radio frequencies of 2400 - 2483,5 of MHz and 5000 - 5999 MHz is not levied.

4. Recommend to operators and providers of telecommunications, since July 1, 2019, not to rate the traffic used for access to the information resources placed in the state subdomain (gov.uz).

5. Permit, according to the procedure of exception, to operators and providers of telecommunications till January 1, 2022 to carry out installation and construction works of objects of telecommunications with development of their design estimates, after approval in accordance with the established procedure of platforms (locations) of radio-electronic means.

6. To the ministry of construction of the Republic of Uzbekistan together with the Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent interested in the ministries and departments without fail at stage of development and approval of design assignments and the design estimates on construction of buildings and constructions of public, administrative, housing and industrial function to provide requirements on:

to assignment in buildings of the respective areas and infrastructures for placement of objects of telecommunication with leading of power supply to them;

to availability in buildings of low-current cable mines for laying of cable networks of telephony, data transmission and the Internet, systems of cable and community reception of radio television, and also the systems "safe house" and security signaling;

to assignment in the residential, public, administrative and industrial territories of the corresponding parcels of land for laying of lines of telecommunications and installation of objects of telecommunications (telecommunication cabinets, antenna towers, masts and others).

7. To the ministry of transport of the Republic of Uzbekistan:

render comprehensive assistance to operators and providers of telecommunications in installation of objects of telecommunications, and also, if necessary, to provide their connection to the power networks which are along the railroads;

provide in case of construction and capital repairs of road and transport infrastructure simultaneous construction along the railroads, and also, if necessary, along highways of the telecommunication sewerage for further provision in lease to operators and providers of telecommunications.

8. To the ministry of development of information technologies and communications of the Republic of Uzbekistan:

together with Agency on development of public-private partnership under the Ministry of Finance in two-month time to develop and approve procedure for projects implementation on the terms of public-private partnership on creation of telecommunication infrastructure and rendering services in the remote and rural settlements for state-financed organizations, and also the population and business entities;
