About approval of Rules of carrying out monitoring of the mass media extended to the territories of the Republic of Kazakhstan, and technique of its calculation

1. Approve:

1) Rules of carrying out monitoring of the mass media extended to the territories of the Republic of Kazakhstan according to appendix 1 to this order;

2) the Method of calculation of monitoring of the mass media extended to the territories of the Republic of Kazakhstan according to appendix 2 to this order.

2. Recognize invalid:

1) the order of the acting minister on investments and development of the Republic of Kazakhstan of January 26, 2016 No. 73 "About approval of Rules of carrying out monitoring of mass media" (it is registered in the Register of state registration of regulatory legal acts at No. 13132, it is published on February 24, 2016 in information system of law of Ad_let);

2) the order of the Minister of information and communications of the Republic of Kazakhstan of June 27, 2016 No. 13 "About introduction of amendments to the order of the acting minister on investments and development of the Republic of Kazakhstan of January 26, 2016 No. 73 "About approval of Rules of carrying out monitoring of mass media" (it is registered in the Register of state registration of regulatory legal acts at No. 13989, it is published on July 26, 2016 in information system of law of Ad_let).

3. To provide to department of state policy in the field of mass media of the Ministry of information and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on official Internet resource of the Ministry of information and social development of the Republic of Kazakhstan after its publication;

4) within ten working days after state registration of this order submission to Legal department of the Ministry of information and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of information and social development of the Republic of Kazakhstan.

5. This order is subject to official publication and becomes effective since April 11, 2019.

Rules of carrying out monitoring of the mass media extended to the territories of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules are developed according to subitem 13-2) of article 4-3 of the Law of the Republic of Kazakhstan "About mass media" (further – the Law) and determine procedure for carrying out monitoring of the mass media extended to the territories of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) mass media - the periodic printing edition, TV, radio channel, film documentary, audiovisual record and other form of periodic or continuous public distribution of mass information, including Internet resources;

2) monitoring of mass media - process of collection and the analysis of products of mass media regarding compliance with law of the Republic of Kazakhstan;

3) products of mass media - the circulation or part of circulation of separate number of the periodic printing edition or audiovisual program, separate release of radio - the TV, film chronicle program, information placed on Internet resource;

4) online media - the Internet resource which underwent the procedure of registration in authorized body which information and communication infrastructure is placed in the territory of the Republic of Kazakhstan;

5) Internet resource - the electronic information resource displayed in text, graphical, audiovisual or other type, placed on the hardware and software, having the unique network address and (or) domain name and functioning on the Internet;

6) the periodic printing edition - the newspaper, the log, the almanac, the bulletin, the appendices to them having the permanent name, the current issue and issued at least once in three months;

7) TV, radio channel - the mass media representing set TV, radio programs and audiovisual works, plots and materials created according to broadcasting schedule for the subsequent broadcasting and/or relaying.

3. Monitoring of mass media is performed with use of the information system "The Automated Monitoring of National Information Space".

Chapter 2. Procedure for carrying out monitoring of the mass media extended to the territories of the Republic of Kazakhstan

4. Monitoring of the mass media extended to the territories of the Republic of Kazakhstan is carried out by authorized body in the field of mass media and TV and radio broadcasting (further - authorized body) for the purpose of identification and fixation of violations of regulations of the legislation of the Republic of Kazakhstan.

5. Act as object of monitoring:

1) TV, radio channels;

2) periodic printing editions;

3) Internet resources and online medias;

4) film documentary;

5) audiovisual record.

6. Carrying out monitoring of mass media includes the following stages:

1) viewing (listening) of products of mass media, identification, fixing and collection of violations;

2) the legal analysis and generalization of information on violations in mass media;

3) the additional analysis of the elicited facts of violations of the law which is carried out by authorized body.

7. By results of monitoring the following data are specified:

1) specification on the addressee:

for periodic printing editions - the name of the owner of mass media, legal address, the official e-mail address;

for TV, radio channels - the name of the owner of mass media, legal address, the official e-mail address;
