About creation of public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center", recognition invalid and change of some regulations

No. 90-93, 401), parts (2) article 32 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), Items b) and e) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412) and parts (1) article 12 of the Law No. 246 from 23/2017 on the state and municipal companies (The official monitor of the Republic of Moldova, 2017, Art. No. 441-450, 750) DECIDES: the Government

1. Reorganize the state company "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" by transformation to public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center", and quality of the founder will perform the Ministry of Health, work and social protection.

2. The public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" is successor of the rights and obligations of the state company "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center".

3. To perform release of personnel in connection with reorganization of the state company "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" according to the labor law in case of impossibility of its translation.

4. Establish the extreme number of staff of public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" in number of 315 units, including 49 units of the workers occupied in production departments and 18 units - in the dining room.

5. To transfer property of the state company "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" to public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" according to requirements of the Regulations on procedure for transfer of objects of state-owned property approved by the Order of the Government No. 901/2015.

6. The functions and services which are carried out and provided according to the current legislation the reorganized legal entities are transferred to public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" with ensuring compliance with the Law No. 133/2011 on personal data protection.

7. In a month from the date of registration in the Agency of the state services to provide to public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" transfer of remaining balance of financial resources from the bank accounts opened addressed to suppliers of paid services for the bank accounts opened on the single treasurer account of the Ministry of Finance. After this term only bank accounts opened on the single treasurer account of the Ministry of Finance will be used in activities.

8. Approve:

1) the Charter of public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" according to appendix No. 1;

2) Structure of public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" according to appendix No. 2;

3) to Organigramm of public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" according to appendix No. 3;

4) Changes which are made to some orders of the Government, according to appendix No. 4. To 9 Ministry of Health, work and social protection:

1) from the date of entry into force of this resolution to develop and provide to the Government for approval Methodology of calculation of rates for the services provided by public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center" to 3-month time;

2) from the date of approval of the specified methodology to develop and provide to the Government for approval the List of the provided services and rates for them to 2-month time.

10. Before approval of the Methodology provided in Item 9, and the new rates calculated on its basis applicable fares on the services provided by the reorganized legal entity will be applied.

11. To the agency of public services upon the demand of the owner to make necessary changes to cadastral and constituent documents.

12. Declare invalid the Order of the Government No. 87/2002 about expansion of functions and increase in overall performance of the Republican experimental prosthetic and orthopedic and rehabilitation center (The official monitor of the Republic of Moldova, 2002, Art. No. 21-22, 158).

13. This resolution becomes effective from the date of publication.

Changes which are made to some orders of the Government

1. In Item 9 of appendix No. 8 to the Order of the Government No. 743/2002 on compensation of employees of the self-supporting companies (The official monitor of the Republic of Moldova, 2002, Art. No. 79-81, 841) to make the following changes:

1) words "Ministry of Health" shall be replaced with words "The Ministry of Health, work and social protection";

To add 2) with line item of the following content:

"Public organization "Republican Experimental Prosthetic and Orthopedic and Rehabilitation Center".

2. In Item 2 of the Regulations on procedure for the ensuring some categories of citizens with supportive technical means approved by the Order of the Government No. 567/2011 (The official monitor of the Republic of Moldova, 2011, Art.
