1. Approve the enclosed Regulations on compensation from the federal budget of the costs suffered by person in connection with storage, demontazhy, transportation (transportation), overload (loading, unloading) of goods concerning which during conducting customs inspection violation of international treaties and acts in the sphere of customs regulation and (or) the legislation of the Russian Federation on customs regulation is not established.

2. Determine that financial provision of the payment commitments connected with implementation of this resolution is performed within the budgetary appropriations of the federal budget provided to the Federal Customs Service on functioning of bodies in the sphere of homeland security, law-enforcement activities and defense.

3. Declare invalid the order of the Government of the Russian Federation of August 19, 2011 No. 704 "About approval of the Regulations on compensation by customs authorities of expenses (costs) suffered by person in connection with storage of goods concerning which during conducting customs inspection violation of the customs legislation of the Customs union within EurAsEC and (or) the legislation of the Russian Federation on customs affairs" (The Russian Federation Code, 2011, No. 35, the Art. 5091) is not established.

4. This resolution becomes effective after 30 days after day of its official publication.

1. This Provision determines procedure for compensation from the federal budget of the costs suffered by person from whom goods are withdrawn, in connection with storage, demontazhy transportation (transportation), overload (loading, unloading) of goods concerning which during conducting customs inspection violation of international treaties and acts in the sphere of customs regulation and (or) the legislation of the Russian Federation on customs regulation is not established.

2. Cost recovery, suffered by person in connection with storage, demontazhy, transportation (transportation), overload (loading, unloading) of the goods withdrawn from it during conducting customs inspection and placed on warehouse of temporary storage, warehouse of temporary storage of customs authority or transferred to storage of the organization performing warehousing services in the region of activities of customs authority (further respectively - warehouse, cost recovery), is performed at the expense of means of the federal budget if during conducting customs inspection it is not determined that concerning such goods the international contracts and acts in the sphere of customs regulation and (or) the legislation of the Russian Federation on customs regulation are broken.

3. Cost recovery is performed by customs authorities based on the statement of person whose goods are withdrawn and placed on warehouse (further - the statement).

4. The application is submitted by person whose goods are withdrawn (the representative of person with appendix of the original of the power of attorney confirming powers of the representative of person), in any form addressed to the chief of customs authority which made withdrawal of goods.

5. The following data are specified in the statement:

a) surname, name, the applicant's middle name - the individual entrepreneur or the name of the applicant - the legal entity;

b) passport data and identification taxpayer number of the applicant - the individual entrepreneur or the primary state registration number, identification taxpayer number, reason code of registration of the applicant - the legal entity;

c) the residential address of the applicant - the individual entrepreneur or the applicant's address - the legal entity;

d) basis for cost recovery;

e) date of goods placement on warehouse and (or) date (dates) of rendering services in dismantle, transportation (transportation), overload (loading, unloading) of goods;

e) the name of the warehouse keeper and (or) person (persons) who rendered (rendered) services in dismantle, transportation (transportation), overload (loading, unloading) of goods;

g) bank account details for money transfer.

6. Are enclosed to the application:

a) originals of the documents confirming payment of storage expenses of goods in warehouse and (or) their dismantle, transportation (transportation), overload (loading, unloading);

b) the copy of the act of return of the goods withdrawn during conducting customs inspection.

7. The application is considered by customs authority within 30 days from the date of its giving. By results of consideration of the application the customs authority within 3 days from the date of adoption of the relevant decision sends to the applicant the notification in writing on the made decision.

8. Transfer of money by customs authority to the bank account specified in the statement is performed within 15 days from the date of adoption by customs authority of the decision on cost recovery.
