About measures for further enhancement of activities of the preschool educational organizations

According to the resolution of the President of the Republic of Uzbekistan of September 30, 2018 No. PP-3955 "About measures for enhancement of management system preschool education", and also for the purpose of further enhancement of system of preschool education, forming of healthy, active, full-fledged, socially adapted identity of the child, creation of the favorable circle for training, education and integration of children with different violations in development, and also the children needing rehabilitation and improvement, the Cabinet of Ministers decides:

1. Approve:

Regulations on the state and non-state preschool educational organizations of general type according to appendix No. 1;

Regulations on groups of short-term stay in the preschool educational organizations according to appendix No. 2;

Regulations on the multidisciplinary specialized preschool educational organizations and the preschool educational organizations of the combined type according to appendix No. 3;

Regulations on the medico-psychology and pedagogical commission on the direction of children in the multidisciplinary specialized preschool educational organizations and the preschool educational organizations of the combined type according to appendix No. 4.

2. To provide to the ministry of preschool education together with the Ministry of Health, the Ministry of Economy and Industry, the Ministry of Finance of the Republic of Uzbekistan, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent action research of the state specialized preschool educational institutions of the republic and following the results of studying to develop and make offers in the Cabinet of Ministers of the Republic of Uzbekistan:

till July 1, 2019 - on optimization of activities of the state specialized preschool educational institutions of Tashkent;

till December 1, 2019 - on optimization of activities of the state specialized preschool educational institutions of the Republic of Karakalpakstan and areas.

3. Establish:

since May 1, 2019 the allowance in the amount of 100 percent to official pay rates and base wage rates of the leading, pedagogical and health workers of the state multidisciplinary specialized preschool educational organizations;

since September 1, 2019 allowances in the amount of 100 percent to official pay rates and base wage rates of assistants to tutors of the state multidisciplinary specialized preschool educational organizations, and also assistants to tutors, the pedagogical and health workers working in groups for children with physical or mental violations in development in the state preschool educational organizations of the combined type.

4. To the ministry of preschool education, the Ministry of employment and employment relationships and the Ministry of Finance of the Republic of Uzbekistan in three-months time to review standard established posts of the state preschool educational organizations of general type, the multidisciplinary specialized preschool educational organizations and preschool educational organizations of the combined type.

5. The state inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan, to the Ministry of preschool education and the Ministry of Health in three-months time to make in the Cabinet of Ministers offers on modification and amendments in Regulations on licensing of activities in the field of rendering non-state educational services, proceeding from provisions of this resolution.

6. Recognize invalid paragraphs two - the fourth Item 1 of the resolution of the Cabinet of Ministers of July 19, 2017 as No. 528 "About enhancement of activities of preschool educational institutions" (the joint venture of the Republic of Uzbekistan, 2017, No. 7, the Art. 153) and appendices No. 1 - 3 to it.

7. To the ministry of preschool education of the Republic of Uzbekistan together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

8. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan concerning social development A. A. Abdukhakimov, the minister of preschool education of the Republic of Uzbekistan A. V. Shin and the Minister of Health of the Republic of Uzbekistan A. K. Shadmanov.

Regulations on the state and non-state preschool educational organizations of general type

Chapter 1. General provisions

1. This Provision determines the purposes and tasks, the rights, obligations and responsibility of the state and non-state preschool educational organizations of general type (further - the preschool educational organizations), and also procedure for the organization of their activities.

2. In this Provision the following concepts are used:

the preschool educational organization - the state or non-state preschool educational organization of general type;

the state preschool educational organization - the organization financed and managed by the state and providing preschool educational services according to the State requirements to development of children of early and preschool age;

the non-state preschool educational organization - the legal entity rendering educational services in the field of preschool education based on the license granted in the procedure established by the legislation and also according to the State requirements to development of children of early and preschool age;

legal representatives of the child are parents of the child or person, them replacing.

3. Action of this provision does not extend to the multidisciplinary specialized preschool educational organizations and the preschool educational organizations of the combined type.

4. The preschool educational organizations perform the activities according to the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "About education" and other laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers, the State requirements to development of children of early and preschool age, this Provision and the charter.

5. The preschool educational organizations can be state and non-state.

6. Accreditation of the preschool educational organization is performed by authorized state body on the basis of certification according to the procedure, established by the legislation.

7. The state preschool educational organization is legal entity, has seal with the image of the State Emblem of the Republic of Uzbekistan and the name in state language and stamp, separate balance, budget and off-budget treasurer personal accounts.

8. The non-state preschool educational organization is legal entity, has the isolated property, has separate balance, answers for the obligations the property which is at its disposal, can have seal and stamp with the name.

Chapter 2. Purposes and tasks of the preschool educational organization

9. The purposes of the preschool educational organization are:

ensuring realization of the right of the child to education;

preserving and strengthening of physical, intellectual and spiritual development of the child;

ensuring social adaptation of the child and readiness to continue education in educational institutions.

10. Tasks of the preschool educational organization are:

creation of the favorable circle allowing children, including children with special needs to receive individual educational programs, and also modern inclusive preschool education and education;

forming at children of feeling of love for the country, respect for family, national, historical, cultural values of the people, respect for the environment;

forming of the identity of the child, development of its creative capabilities, acquisition of social experience by it;

ensuring social adaptation of the child and his readiness for primary education;

implementation of modern educational programs and technologies in educational and educational process.

Chapter 3. Procedure for creation, reorganization and liquidation of the preschool educational organization

11. The state preschool educational organization is created in the form of the legal entity and performs the activities based on the charter.

12. State bodies, public authorities on places and other state organizations can be founders of the state preschool educational organization.

13. Legal entities - persons of law of private property and physical persons can be founders of the non-state preschool educational organization.

14. Buildings and constructions of the state preschool educational organizations are not subject to privatization, alienation and reshaping without approval of the Ministry of preschool education of the Republic of Uzbekistan.
