About approval of rules of placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements

According to the subitem 1) item 4 of article 17-1 of the Law of the Republic of Kazakhstan of December 19, 2003 "About advertizing", PRIKAZYVAYU:

1. Approve the enclosed Rules of placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements.

2. To provide to committee on cases of construction and housing and communal services of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective from the date of the first official publication.

Rules of placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements

Chapter 1. General provisions

1. These rules of placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements (further - Rules) are developed according to the subitem 1) of item 4 of article 17-1 of the Law of the Republic of Kazakhstan of December 19, 2003 "About advertizing" and determine procedure for placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements.

2. In these rules the following concepts are used:

1) advertizing - the information distributed and (or) placed in any form by means of any means, intended for the indefinite group of people and designed to create or maintain interest in physical person or legal entity, goods, trademarks, works, services and to promote their realization;

2) outdoor (visual) advertizing - the advertizing placed on objects of outdoor (visual) advertizing and available to visual acceptability on open space outside rooms in settlements, in band of withdrawal of highways public on open space outside rooms out of settlements and out of band of withdrawal of highways public;

3) object of outdoor (visual) advertizing - construction, different volume or sheet constructions, including screens and electronic boards, light constructions, and other means used for distribution and (or) advertizing.

3. Placement of outdoor (visual) advertizing is performed by display and drawing advertizing images and (or) information on objects of outdoor (visual) advertizing.

4. Placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements is performed according to the Land code of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities, highways and on traffic.

5. Objects of outdoor (visual) advertizing shall conform to national standards and shall be made and established taking into account requirements of the state standard rates in the field of architecture, town planning and construction, highways, traffic and standardization.

6. Objects of outdoor (visual) advertizing shall not reduce transport and operational qualities of the road, violate safety requirements of movement of vehicles and environmental protection, to have similarity to route signs and pointers, to worsen their visibility or efficiency of perception, to blind users of the road.

Chapter 2. Procedure for placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements

7. Placement of objects of outdoor (visual) advertizing on open space outside rooms in settlements is performed based on the appropriate right to the parcel of land and the following stages:

1) receipt of architectural and planning task (further - APZ) and specifications for development of the sketch (outline sketch);

2) approval of the sketch (outline sketch) of the structural division of local executive body performing functions in the field of architecture and town planning;

3) construction of object of outdoor (visual) advertizing.

8. Receipt of APZ and specifications, approval of the sketch (outline sketch) are performed according to the Rules of the organization of building and passing of allowing procedures in the field of construction approved by the order of the Minister of national economy of the Republic of Kazakhstan of November 30, 2015 No. 750 (it is registered in the Register of state registration of regulatory legal acts for No. 12684).

9. In case of placement of objects of outdoor (visual) advertizing in close proximity to buildings and constructions requirements of construction regulations and fire safety regarding ensuring access of fire divisions to buildings and constructions, and also observance of fire-proof gaps and yellow lines are observed.

10. In case of installation (mounting) of object of outdoor (visual) advertizing requirements and regulations of fire safety connected with production of installation and construction works, and also hot work using naked flame and sources of ignition are considered.

11. Owners of objects of outdoor (visual) advertizing:

contain objects of outdoor (visual) advertizing in proper esthetic, sanitary and technical condition;

ensure safety of objects of outdoor (visual) advertizing for life and human health, property of all patterns of ownership;

in the absence of outdoor (visual) advertizing on object of outdoor (visual) advertizing on a grant basis place social advertizing on object of outdoor (visual) advertizing or dismantle object (outside) visual advertizing within thirty calendar days after placement term.
