About approval of the Regulations on procedure for provision by banks of information on opening/closing of accounts of the physical persons entered in the Unified register of debtors, in bodies of the public executive service or private contractors

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 62-1 of the Law of Ukraine "About banks and banking activity" the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on procedure for provision by banks of information on opening/closing of accounts of the physical persons entered in the Unified register of debtors, in bodies of the public executive service or private contractors which are applied.

2. Banks send notifications on opening/closing of accounts of the physical persons entered in the Unified register of debtors, in bodies of the public executive service or private contractors in paper form before receipt of the message of the National Bank of Ukraine on the beginning of work of electronic service of information interaction which is entered by the administrator of the automated system of enforcement proceeding determined by the Regulations on the automated system of enforcement proceeding approved by the order of the Ministry of Justice of Ukraine of August 05, 2016 for No. 2432/5, No. 1126/29256 registered in the Ministry of Justice of Ukraine on August 12, 2016.

3. To department of payment systems and innovative development (Alexander Yablunivsky):

1) after official publication to inform banks information on adoption of this resolution;

2) to inform banks on the beginning of work of electronic service of information interaction after its introduction.

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Sergey Holod.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on procedure for provision by banks of information on opening/closing of accounts of the physical persons entered in the Unified register of debtors, in bodies of the public executive service or private contractors

1. This Provision is developed according to requirements of the Laws of Ukraine "About the National Bank of Ukraine", "About banks and banking activity", "About enforcement proceeding", "About electronic confidential services" and other legislation of Ukraine.

2. The bank shall:

1) in the opening day or closings of accounts to physical persons to check availability of information on entering of information about these physical persons into the Unified register of debtors;

2) in case of availability in the register of information on physical person debtor in day of opening/account termination to send to body of the public executive service or the private contractor (further - the contractor) the notification on opening/account termination (further - the notification) such person.

3. The bank checks availability of information on entering of information about physical persons into the Unified register of debtors by forming of request in the Unified register of debtors in electronic form and receives on each request the receipt answer on availability/lack of the relevant information in the Unified register of debtors.

4. The notification (in paper/electronic type) which the bank sends to the contractor, shall contain all obligatory details specified in the form given in appendix to this Provision.

The electronic form of the notification, except obligatory details, may contain additional technological details which do not belong to information on opening/closing of accounts of physical persons debtors, in the amount necessary for the organization of information interaction in electronic form.

5. Information interaction in electronic form on verification of information on entering of information about physical persons into the Unified register of debtors and informing the contractor is provided according to the regulations of information interaction developed by the administrator of the automated system of enforcement proceeding (further - the administrator), the certain Regulations on the automated system of enforcement proceeding approved by the order of the Ministry of Justice of Ukraine of August 05, 2016 for No. 2432/5, No. 1126/29256 registered in the Ministry of Justice of Ukraine on August 12, 2016.

6. For information security which is transferred and accepted according to the procedure of information interaction by the administrator and banks the organizational and technical actions providing information security with limited access according to the Law of Ukraine "About information security in information and telecommunication systems" take root.

The organization of information security in banks is performed according to regulatory legal acts of the National Bank of Ukraine.

7. For confirmation of authenticity of origin and integrity of data in notifications the qualified electronic seal is used.

8. The notification in paper form before implementation of electronic service of information interaction behind the authorized signature of bank is provided to the contractor under list or goes by mail with the assurance of receipt no later than the working day following behind day of opening/account termination.

After implementation of electronic service of information interaction in case of availability of the technical bases excluding interaction between bank and the contractor in electronic form, the notification moves in paper form.

9. Information provided in notifications according to this Provision is bank secrecy. Requirements for protection, storage, use and disclosure of information which contains bank secrecy are determined by the regulatory legal act of the National Bank of Ukraine.
