Determine that the regulations containing in Rules and the Provision which are approved by this resolution are applied if other is not established by the acts of the Government of the Russian Federation determining features of marking of the separate goods which are subject to obligatory marking by means of identification, and implementation of the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification concerning the specified goods.

3. The realization of this resolution is enabled by the corresponding federal executive bodies within the number of their workers and budgetary appropriations provided by it in the federal budget on management and management in the sphere of the established functions established by the Government of the limiting Russian Federation.

Rules of marking of the goods which are subject to obligatory marking by means of identification

I. General provisions

1. These rules determine procedure for marking of the goods which are subject to obligatory marking by means of identification, including rules of forming and drawing the means of identification and procedure for representation by participants of turnover of goods which are subject to obligatory marking by means of identification (further - the participant of turnover of goods), to the operator of the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further respectively - the operator, information system of monitoring), information on turnover of goods which are subject to obligatory marking by means of identification for its inclusion in information system of monitoring.

2. For the purposes of these rules the following concepts are used:

"input of goods in turnover" - in case of production of goods:

in the territory of the Russian Federation - primary paid or voluntary conveyance of goods from the producer to the new owner or the other person for the purpose of its alienation to such person or for the subsequent realization which makes it available for distribution and (or) use;

out of the territory of the Russian Federation (except for the goods imported from state members of the Eurasian Economic Union) - release by customs authorities for internal consumption of the goods imported into the Russian Federation;

out of the territory of the Russian Federation concerning the goods imported from state members of the Eurasian Economic Union - import by the legal entity or physical person registered as the individual entrepreneur, goods to the Russian Federation;

"goods conclusion from turnover" - realization (sale) of the marked goods to the physical person for private consumption, withdrawal (confiscation), utilization, destruction, irretrievable loss, withdrawal of goods, realization and sale of the goods which were earlier in circulation in the territory of the Russian Federation out of limits of the Russian Federation, use for own needs, and also other actions assuming the termination of further turnover of goods;

"marking code" - the unique sequence of symbols created by the operator, consisting of code of identification and code of check;

"identification code" - the sequence of symbols representing unique number of copy of goods;

"check code" - the sequence of symbols created as a result of cryptographic transformation of code of identification and allowing to reveal falsification of code of identification in case of its check with use of the fiscal store and (or) technical means of check of code of check;

"commodity code" - the unique code assigned for group of goods at their description in the information resource providing accounting and storage of reliable data about goods on the corresponding commodity nomenclature;

"private office" - placed on the Internet (further - Internet network) on the website of the operator the information service provided by the operator in accordance with the established procedure to the participant of turnover of goods or federal executive body and used by the operator, the participant of turnover of goods and federal executive body;

"turnover of goods" - storage, transportation, obtaining and transfer of goods, including its acquisition and realization (sale), in the territory of the Russian Federation;

"the disposal registration device" - the technical tool of information exchange intended for transfer to information system of monitoring of data on conclusion from turnover of goods, including the hardware-software cryptography (cryptographic) technical tool of check of codes of check concerning which the Federal Security Service of the Russian Federation issues the document on its compliance to the established requirements to the cryptographic (cryptographic) means of information protection operating concerning the cryptography (cryptographic) tools intended for check of codes of marking;
