RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of February 15, 2002 No. 153

About creation of single system of attraction, use and monitoring of the international technical assistance

(as amended on 19-08-2022)

For the purpose of coordination of the work connected with attraction, provision and effective use of the international technical assistance, the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for attraction, use and monitoring of the international technical assistance it (is applied).

2. Determine that official appeals to the countries and the international organizations - partners in development about attraction and use of the international technical assistance go the Secretariat of the Cabinet of Ministers of Ukraine.

3. As to the coordinator of activities connected with attraction of the international technical assistance to provide to the secretariat of the Cabinet of Ministers of Ukraine, trade and agricultural industry forming of strategic programs of the international technical assistance according to the Program of activities of the Cabinet of Ministers, the Agreement on association between Ukraine, on the one hand, and the European Union, European Atomic Energy Community and their state members, on the other hand, of the Sustainable development goals approved by the resolution of the General Assembly of the United Nations of September 25, 2015 No. 70/1, of regional development strategies, other strategy.

4. No. 1072 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 04.12.2019.

5. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of April 18, 1996 No. 441 "About state registration of programs and projects of the international technical assistance" (the joint venture of Ukraine, 1996, No. 10, the Art. 301);

Item of 19 changes which are made to the acts of the Cabinet of Ministers of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 25, 1998 No. 1336 (The Official Bulletin of Ukraine, 1998, No. 34, by the Art. 1277);

the resolution of the Cabinet of Ministers of Ukraine of February 8, 1999 No. 170 "About approval of the Regulations on procedure for accreditation of the organizations which provide program implementation and projects of the international technical assistance" (The Official Bulletin of Ukraine, 1999, No. 6, to the Art. 194).

Procedure for attraction, use and monitoring of the international technical assistance

General provisions

1. This Procedure determines the procedure of attraction, use and monitoring of the international technical assistance, including state registration, monitoring of projects (programs), accreditations of contractors (legal entities - nonresidents), registration of representative office of donor organization in Ukraine.

Action of this Procedure does not extend to projects (programs) which are financed by the international development Agency of the USA according to Item (c) article 7 of the Agreement on task performance in the field of development between the Government of Ukraine and the Government of the United States of America for assistance to more transparent and accountable management processes with broad participation of citizens and Item (c) article 7 of the Agreement on task performance in the field of development between the Government of Ukraine and the Government of the United States of America for assistance to sustainable economic development on wide public basis as means of ensuring of steady democracy in Ukraine regarding determination of the beneficiary and its participation in process of attraction, use and monitoring of the international technical assistance.

Action of this Procedure does not extend to projects (programs) directed to support of development of institutes of civil society regarding determination of the beneficiary and its participation in process of attraction, use and monitoring of the international technical assistance.

Action of this Procedure does not extend to projects (programs) which are financed by the North Atlantic Treaty Organization (NATO) according to the Agreement between the Government of Ukraine and the North Atlantic Treaty Organization on the status of Representative office of NATO in Ukraine.

2. Concepts which are used in this Procedure have the following value:

the beneficiary - the central executive body, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev, Sevastopol city state administration within which competence forming and/or realization of state policy in the respective areas or the region where implementation of the project (program) which is interested in results of project implementation (program), executive body of local self-government which jurisdiction extends to the territory of project implementation (program), the Secretariat of the Cabinet of Ministers of Ukraine, Office of the President of Ukraine, committees and the Office of the Verkhovna Rada of Ukraine, National Bank, the Supreme Court, the supreme specialized courts, National anti-corruption bureau, Audit Chamber, other state bodies is supposed is;

the contractor - any person (the resident or the nonresident) having the written agreement with the partner in development or person authorized by the partner in development also provides project implementation (programs), including on paid basis;

the responsible person - physical person which is intended by the recipient (beneficiary) for the organization of the works connected with project implementation (program) and which directly prepares reports for representation the Secretariat of the Cabinet of Ministers of Ukraine;

the partner in development - foreign state, the government and bodies or the organizations, foreign municipal body or the international organization authorized by the government of foreign state which provide the international technical assistance according to international treaties of Ukraine;

institutes of civil society - public associations, religious, charitable organizations, the creative unions, labor unions and their associations, the organizations of employers and their consolidation, the non-state mass media legalized according to the legislation of Ukraine;

the project coordinator (programs) - the deputy manager of the beneficiary or the head of the structural unit of the beneficiary who is authorized the beneficiary to provide supervision of project implementation (program), preparation of results of the current and/or final monitoring and representation their Secretariat of the Cabinet of Ministers of Ukraine;

the international technical assistance - financial and other resources and services which according to international treaties of Ukraine are provided by partners in development on non-paid and irretrievable basis for the purpose of support of Ukraine;

monitoring of projects (programs) - watch system behind condition of project implementation (program);
