About approval of Aviation rules of Ukraine, Part 47 "Rules of registration of civil air vehicles in Ukraine"

According to requirements of Articles 11, 39, 41 Air code of Ukraine, Item 8 of the Regulations on the Public air service of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 8, 2014 No. 520, for the purpose of ensuring compliance with standards and recommended practice of International Civil Aviation Organization of PRIKAZYVAYU:

1. Approve Aviation rules of Ukraine, Part 47 "Rules of registration of civil air vehicles in Ukraine" which are attached.

2. (Ovchinnikov V. M.) in the procedure established by the legislation to provide to department of the flight validity:

1) submission of this order on state registration in the Ministry of Justice of Ukraine;

2) promulgation of this order on the official website.

3. The registration certificates of the air vehicle, temporary accounting certificates of the air vehicle issued according to the Aviation rules of Ukraine, Part 47 "Rules of registration of civil air vehicles in Ukraine" approved by the order of the Ministry of infrastructure of Ukraine of October 25, 2012 No. 636, registered in the Ministry of Justice of Ukraine on November 16, 2012 for No. 1926/22238, are effective during the effective period established in them.

4. Declare invalid the order of the Ministry of infrastructure of Ukraine of October 25, 2012 No. 636 "About approval of Aviation rules of Ukraine, Part 47 "Rules of registration of civil air vehicles in Ukraine", registered in the Ministry of Justice of Ukraine on November 16, 2012 for No. 1926/22238.

5. This order becomes effective from the date of its official publication.

Aviation rules of Ukraine, Part 47 "Rules of registration of civil air vehicles in Ukraine"

I. General provisions

1. These Aviation rules are obligatory for all subjects of aviation activities.

2. These Aviation rules determine the procedure and requirements to registration (re-registration) of civil air vehicles (further - air vehicles) in the State register of civil air vehicles of Ukraine, procedure for their exception of this register, provision and drawing the state and registration signs on air vehicles, procedure for temporary accounting of the new, modified air vehicles and air vehicles after their maintenance.

3. In these Aviation rules terms are used in such values:

general aviation - the aircraft which is not used for implementation of commercial air transportations and accomplishment of aerial works;

autogyro - the heavier-than-air aircraft supported in flight due to interaction of air with one or several rotors which are freely rotating around the axes which are approximately in vertical position;

aerostat - the lighter-than-air aircraft moving in air without the power unit;

the drone aircraft - the air vehicle intended for flight execution without pilot onboard, which flight control and control behind which are performed by means of the special control station located out of the air vehicle. Pilotless uncontrollable aerostats and remotely piloting aircrafts belong to drone aircrafts;

the helicopter - the heavier-than-air aircraft which is supported in flight mainly due to interaction of air with one or several rotors which rotate the power unit around the axes which are approximately in vertical position;

the owner of the air vehicle - legal entity or physical person which property right to the air vehicle is supported by the relevant documents;

the refractory - material which maintains heating as steel or is better;

the helicopter - the heavier-than-air aircraft which moves by means of the power unit and is supported in air due to interaction of air with one or several rotors;

the hang glider - the motorless heavier-than-air aircraft which lifting force in flight is created generally due to aerodynamic reactions to surfaces that allows to move in such flight conditions and control in flight is exercised, mainly, due to movement of center of mass (balancer management) on which take off and landing are performed by means of the pilot's legs;

State of Registry - the state in which register of air vehicles the air vehicle is registered;

the public air vehicle - the air vehicle which is used in the military, border service, service of civil protection, in bodies of National police and monitoring bodies;

the state sign of the air vehicle - sign which consists of several symbols and shows national identity of the air vehicle. It is provided to State of Registry by International Civil Aviation Organization (_SAO). This sign is provided by authorized body concerning civil aviation to air vehicles which are registered in the State register of civil air vehicles of Ukraine;

The state register of civil air vehicles of Ukraine - the book and the electronic database in which the current register of the civil air vehicles and drone aircrafts registered in Ukraine is kept;

the airship - the flight vehicle, lighter-than-air, set in motion by the power unit;

remotely the piloting aircraft - the drone aircraft which is piloted from Item of remote piloting;

very much the light aircraft - the air vehicle which has no more than two places, inclusive with places of crew and the maximum take-off mass no more than 750 kg. For very light helicopter the maximum take-off mass - no more than 600 kg;

the experimental air vehicle - prototype of the air vehicle, the modified or new air vehicle on which the organization of developer of civil aviation engineering approved by authorized body concerning civil aviation carries out testing or developmental, experimental and research works;

the operator - legal entity or physical person which operates or offers services in operation of air vehicles;

the request - the appeal of the applicant to authorized body concerning civil aviation for the purpose of receipt of the state and registration signs for the air vehicle, registration of its (re-registration) in the State register of civil air vehicles of Ukraine or its exception of the register;

the applicant - the owner of the air vehicle either other legal entity, or physical resident person who according to the written order of the owner submitted the application to authorized body concerning civil aviation for the purpose of receipt of the state and registration signs, registration (re-registration), exception, the organization of developer, the producer of civil aviation engineering, the organization of maintenance approved by authorized body concerning civil aviation which submitted the application for the temporary accounting certificate, the organization of developer of civil aviation engineering approved by authorized body concerning civil aviation which submitted the application for the purpose of receipt of the state and registration signs, registration (re-registration), exception of the experimental air vehicle;

commercial aviation - the aircraft used for regular or irregular air-transport public conveyances, mail or load and accomplishment of aerial works for a fee or according to the employment contract;
