About declaration of the public usefulness of works of national value on construction of the Customs terminal the Center and zones provided for expansion

This organic law is adopted based on provisions of article 106/1 of the Constitution by acceptance on itself responsibility the Government before Parliament.

Art. 1. - Based on Item about) parts (1) Article 5 and Item and) parts (1) article 6 of the Law on expropriation for the socially useful purposes No. 488/1999 to proclaim public usefulness of works of national value on construction of the Customs terminal the Center and zones, provided for expansion.

Art. 2. - Object of expropriation is real estate (earth) of private property with cadastral numbers 5511105150, of 5511105151, 5511105153 and 5511105154, used for works of national value on construction of the Customs terminal the Center and zones, provided for expansion.

Art. 3. - In departure from provisions of Articles 71 and 83 of the Land code No. 828/1991 withdrawal from agricultural land turnover with cadastral numbers 5511105036 - 5511105037; 5511105070 - 5511105085; 5511105115; 5511105119 - 5511105171; 5511105176; 5511105179 - 5511105183; 5511105187 - 5511105190, used for works of national value on construction of the Customs terminal the Center and zones, provided for expansion, it is performed owing to this law and is final.

Art. 4. - In departure from part provisions (4) article 12 of the Law on standard price and procedure for purchase and sale of the earth No. 1308/1997 of loss, caused by conclusion of lands from category of lands of agricultural purpose, are compensated by the investor according to the rates specified in line item of III appendix to the Law on standard price and procedure for purchase and sale of the earth No. 1308/1997, and are transferred into the budget of administrative and territorial unit in the territory of which there is parcel of land.

Art. 5. - To provide to the government on behalf of the state necessary measures on:

- to change of category of purpose of the farmlands specified in Article 3, with transfer in category of the lands intended for construction owing to compensation of losses by the investor;

- expropriations of the real estate (earth) specified in Article 2, of the carrying out socially useful works of national value located on site.

Art. 6. - Payment of compensation for expropriation of the real estate (earth) specified in Article 2, is performed by the Government by financial means of the investor or the successor of its rights and obligations selected on competitive basis by Customs Service.

Art. 7. - This law becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
