According to Item 39 of Article 1 and the subitem 6) Item 1 of Article 7, and also Item 7 of article 170 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" PRIKAZYVAYU:

1. Approve:

1) the Standard of the organization of rendering medical services in transplantation of fabrics (part of fabric) and (or bodies (part of bodies) in the Republic of Kazakhstan, and other types of medical care to donors and recipients according to appendix 1 to this order;

2) Rules and conditions of withdrawal, procurement, storage, preservation, transportation of fabrics (part of fabric) and (or) bodies (part of bodies) according to appendix 2 to this order.

2. Declare invalid some orders of the Ministry of Health of the Republic of Kazakhstan according to appendix 3 to this order.

3. Make change to the order of the Minister of health and social development of the Republic of Kazakhstan of June 29, 2015 No. 534 "About approval of Rules of forming of the list of the organizations of health care for withdrawal, procurement, storage, preservation, transportation of fabrics (part of fabric), or bodies (part of bodies) and transplantation of fabrics (part of fabrics) or bodies (part of bodies)" (it is registered in the Register of state registration of regulatory legal acts for No. 11743, it is published on June 24, 2015 in information system of law of Ad_let):

Rules of forming of the list of the organizations of health care for withdrawal, procurement, storage, preservation, transportation of fabrics (part of fabrics), or bodies (part of bodies) and transplantation of fabrics (part of fabrics) or bodies (part of bodies)" approved by the specified order to be reworded as follows according to appendix 4 to this order.

4. To provide to department of the organization of medical care of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

5. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Aktayeva L. M.

6. This order becomes effective after ten calendar days after day of its first official publication.

The standard of the organization of rendering medical services in transplantation of fabrics (part of fabric) and (or) bodies (part of bodies) in the Republic of Kazakhstan and other types of medical care to donors and recipients

Chapter 1. General provisions

1. The standard of the organization of rendering medical services in transplantation of fabrics (part of fabric) and (or) bodies (part of bodies) in the Republic of Kazakhstan and other types of medical care to donors and recipients (further - the Standard) is developed according to the subitem 6) of Item 1 of Article 7 and Chapter 2 "Transplantation of fabrics (part of fabric) and (or) bodies (part of bodies) of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code).

2. This Standard establishes requirements to the organization of rendering medical services in fabric transplantation (part of fabric) and (or) bodies (part of bodies) (further - services in transplantation).

3. In this Standard the following terms and determinations are used:

1) the guaranteed amount of free medical care (further - GOBMP) - amount of the medical care provided at the expense of budgetary funds according to the list determined by the Government of the Republic of Kazakhstan, to citizens of the Republic of Kazakhstan, oralmans, and also the foreigners and persons without citizenship who are constantly living in the territory of the Republic of Kazakhstan;

2) the donor - the person, corpse of the person, animal from which are made donor blood sampling, its components, other donor material (including sperm, ova, tissues of reproductive organs, gametes, embryos), and also fabric withdrawal (part of fabric) and (or) bodies (part of bodies) and haematopoietic stem cells for transplantation to the recipient;

3) laboratory of immunological typing (HLA laboratory) - structural division under the organizations performing activities in the sphere of donorship, procurement of blood, its components and medicines;

4) the recipient - the patient to whom transfusion of donor blood or the components and (or) medicines allocated from it, introduction of men's or women's donor material (sperm, ovum, embryos) or fabric transplantation (part of fabric) and (or) body (part of body) from the donor is made;

5) the register of donors of fabric (part of fabric) and (or) bodies (part of bodies) - the database of persons, concordants on non-paid donorship of fabric (part of fabric) and (or) bodies (part of bodies), haematopoietic stem cells typed on system-HLA;

6) the register of recipients of fabric (part of fabric) and (or) bodies (part of bodies) - the database of persons needing fabric transplantation (part of fabric) and (or) bodies (part of the bodies) typed on system-HLA;

7) services in transplantation - medical services in change, engraftment of fabrics and (or) bodies (part of bodies) on other place in organism or in other organism which types are approved by the order of the Minister of health and social development of the Republic of Kazakhstan of December 28, 2016 No. 1112 (it is registered in the Register of state registration of regulatory legal acts for No. 14630);

8) authorized body in the field of health care (further - authorized body) - the central executive body performing management and cross-industry coordination in the field of protection of public health, medical and pharmaceutical science, medical and pharmaceutical education, sanitary and epidemiologic wellbeing of the population, drug circulation and medical products, control of quality of medical services.

Chapter 2. Requirements to donors and recipients and conditions of receipt of medical care by them in connection with the forthcoming surgical intervention on withdrawal of fabrics (part of fabric) and (or) bodies (part of bodies) and for transplantation

4. Person wishing to act as the living donor (further - the potential living donor), provides in the organization of health care, the rendering service in transplantation, consent to withdrawal of fabrics (part of fabric) and (or) bodies (part of bodies) and their voluntary conveyance to the potential recipient on condition of observance of items 4 and the 5th article 169 of the Code, osvidetelstovanny notarially.

5. In cases, stipulated in Item the 6th article 169 of the Code, the written notarially certified consent are presented by legal representatives of minor or incapacitated persons.

6. Services in transplantation are rendered to the foreigners and stateless persons which are legally staying in the territory of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan in the field of population shift.

Stay of specified persons in the territory of the Republic of Kazakhstan proves to be true by provision in the organization of health care, the rendering service in transplantation, notarially certified copies of the identity document, the copy of the visa of the Republic of Kazakhstan or the certificate of temporary registration of the immigrant or the insert to the passport about registration of the immigrant or mark in migratory card.
