1. Approve Rules of establishment of requirements of energy efficiency of goods, works and services in case of order placement in ensuring the state needs (are applied).

2. To the ministries and departments, local executive bodies of the government to take necessary measures for accomplishment of this resolution.

Rules of establishment of requirements of energy efficiency of goods, works and services in case of order placement in ensuring the state needs

1. These rules determine procedure for establishment of requirements of energy efficiency of goods, works and services in case of order placement by accomplishment of the state needs (further Requirements of energy efficiency).

2. In these rules the following basic concepts are used:

- energy efficiency - economically reasonable effective use of energy resources taking into account extent of development of the existing equipment and technology, with respect for requirements of environment protection, achievement of effective use of fuel and energy resources;

- fuel and energy resources (energy resources) set of all types of fuel, the natural and transformed energy of the country which it is subdivided into renewable energy resources, primary energy resources and secondary energy resources;

- public procurements - acquisition by the buying organization of goods, works and services, financed fully or partially by public funds.

3. Requirements of energy efficiency are subject to establishment concerning the following types of goods:

- goods according to appendix to these rules;

- the goods used for creation of elements of structures of buildings, structures, constructions, including the engineering systems influencing energy efficiency of buildings, structures, constructions.

4. If result of performance of works for the state or municipal needs is production or conversion of goods concerning which requirements of energy efficiency are established, then such goods shall conform to the established requirements.

5. If during the course of performance works as material the goods concerning which requirements of energy efficiency are established are used, such goods shall conform to the established requirements of energy efficiency.

6. Requirements of energy efficiency are subject to establishment concerning the works and services which are purchased for ensuring the state needs in the course of accomplishment which rendering considerable amounts of energy resources are spent.

7. In the established requirements of energy efficiency types and types of goods, works, services to which they extend, date with which requirements become effective (but not earlier than 90 days from the date of their approval), and also one or several of the following indicators are specified:

- values of energy efficiency of goods (in case of their availability);

- settlement amounts of the used energy resources;

- measure values of energy efficiency of goods, works and services;

- characteristics, parameters of goods, works, the services influencing amount of the used energy resources.

8. Requirements of energy efficiency in case of public procurements of goods, works and services one of the main conditions is, and in case of determination unproductive expense of energy resources the proposal of the participant in the corresponding procedures of purchases is rejected, except as specified, stipulated by the legislation the Republic of Tajikistan.

9. Requirements of energy efficiency which are subject to obligatory execution:

- for household energy-requiring devices concerning which the authorized state body determines values of energy efficiency;

- the installed management systems lighting require function availability management of illumination according to the set schedule, management of illumination depending on availability (absence) of people indoors and management of illumination depending on intensity of natural lighting with automatic inclusion (switching off) or change of brightness of lighting;

- for sluzhebno - household lighting;

- for lamps of external lighting and lamps for lighting of residential and public buildings - use of energy saving lamps, and also puskoreguliruyushchy devices.
