1. Approve the Procedure for holding actions for freezing and defrosting of financial resources or other property of the physical persons and the organizations included in the list of faces tied with terrorism it (is applied).

2. To the state committee of homeland security of the Republic of Tajikistan and other relevant ministries and departments to take necessary measures for execution of the specified Procedure.

3. Declare invalid the order of the Government of the Republic of Tajikistan of November 2, 2015, No. 646 "About the Procedure for holding actions for freezing and defrosting of financial resources or other property of the physical persons and the organizations included in the list of faces tied with terrorism".

Procedure for holding actions for freezing and defrosting of financial resources or other property of the physical persons and the organizations included in the list of faces tied with terrorism

The procedure for holding actions for freezing and defrosting of financial resources or other property of the physical persons and the organizations included in the list of faces tied with terrorism (further - the Procedure) is developed according to Articles 17 (1) and 17(2) Laws of the Republic of Tajikistan "About fight against terrorism" and parts 7 and 8 of article 6 of the Law of the Republic of Tajikistan "About counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction". This Procedure determines procedures of freezing and defrosting of property (means) of the physical persons and organizations connected with terrorism and distribution of weapons of mass destruction, and also creation of the list of such persons for accomplishment of the international obligations of the Republic of Tajikistan in the sphere of counteraction to terrorism and distribution of weapons of mass destruction provided in resolutions of the Security Council of the United Nations and international treaties which participant is the Republic of Tajikistan.

1. General provisions

1. In this Procedure the following terms are used:

- distribution of weapons of mass destruction - actions for illegal creation, production, acquisition, storage, transportation, transfer or transfer to ownership of other person of weapons of mass destruction, including financing of distribution of weapons of mass destruction for which making the international sanctions are provided;

- the accountable organizations - the organizations performing transactions with money or other property and the stipulated in Article 4 Laws of the Republic of Tajikistan "About counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" and also the physical persons and legal entities performing transactions with money or other property;
