About additional measures in connection with application of the Law of the Azerbaijan Republic "About foodstuff"

For the purpose of ensuring application of the Law of the Azerbaijan Republic "About foodstuff" I decide:

1. Determine that:

- provided by part one of article 6 of the Law of the Azerbaijan Republic "About foodstuff of" power "of relevant organs of the executive authority" perform on issue of the hygienic certificate - the Ministry of Health of the Azerbaijan Republic; on issue of the phytosanitary certificate and veterinary certificate - the Ministry of Agriculture of the Azerbaijan Republic; in issue of the quality certificate food, exported from the Azerbaijan Republic to the countries of the European Union - the Ministry of Economics of the Azerbaijan Republic;

- Articles provided by part two 6, part five of Article 13 and part two of article 17 of the specified Law of power of "relevant organ of the executive authority" are performed by the Cabinet of Ministers of the Azerbaijan Republic;

- provided by part two of article 7 of the specified Law of power of "relevant organ of the executive authority" performs the Ministry of Health of the Azerbaijan Republic;

- provided by part one of article 8 of the specified Law of power of "relevant organs of the executive authority" perform in connection with consumer protection the Ministry of Economics of the Azerbaijan Republic, in connection with observance of health requirements the Ministry of Health of the Azerbaijan Republic, in connection with observance of ecological requirements the Ministry of Ecology and Natural Resources of the Azerbaijan Republic, in connection with observance of veterinary and phytosanitary requirements the Ministry of Agriculture of the Azerbaijan Republic, in connection with observance of requirements of state standards and other regulating documents on standardization the State committee of the Azerbaijan Republic on standardization, metrology and the patent, in connection with customs control the State Customs Committee of the Azerbaijan Republic;

- provided by part two of article 11 of the specified Law of power of "relevant organs of the executive authority" perform within the competence Ministry of Health of the Azerbaijan Republic and Ministry of Ecology and Natural Resources of the Azerbaijan Republic;

- provided by part two of article 16 of the specified Law of power of "relevant organs of the executive authority" perform within the competence Ministry of Economics of the Azerbaijan Republic, Ministry of Health of the Azerbaijan Republic, Ministry of Agriculture of the Azerbaijan Republic, Ministry of Ecology and Natural Resources of the Azerbaijan Republic, State Customs Committee of the Azerbaijan Republic and State Committee of the Azerbaijan Republic on standardization, metrology and the patent;

- provided by part five of article 19 of the specified Law of power of "relevant organ of the executive authority" performs the Ministry of Emergency Situations of the Azerbaijan Republic;

- provided by part one of article 20 of the specified Law of power of "relevant organ of the executive authority" perform in the first case the Ministry of Economics of the Azerbaijan Republic, in the second case the Cabinet of Ministers of the Azerbaijan Republic;

- provided by the paragraph the tenth article 21 of the specified Law of power of "relevant organs of the executive authority" perform within the competence Ministry of Economics of the Azerbaijan Republic, Ministry of Health of the Azerbaijan Republic, Ministry of Agriculture of the Azerbaijan Republic, Ministry of Ecology and Natural Resources of the Azerbaijan Republic, State Customs Committee of the Azerbaijan Republic and State Committee of the Azerbaijan Republic on standardization, metrology and the patent.

2. Charge to the Cabinet of Ministers of the Azerbaijan Republic in a month:

- prepare and provide to the President of the Azerbaijan Republic offers on reduction of regulatory legal acts to compliance with this Decree;

- determine rules of passing of the state hygienic registration of foodstuff and maintaining the state register and to inform on it the President of the Azerbaijan Republic;

- determine rules of implementation of the state control of observance of standards and requirements in the field of quality assurance and safety of foodstuff and to inform on it the President of the Azerbaijan Republic;

- determine rules of withdrawal, neutralization or destruction of foodstuff, unusable to use, and to inform on it the President of the Azerbaijan Republic;

- determine amount, the nomenclature, rules of forming, storage, use and periodic updating of the state food inventories and to inform on it the President of the Azerbaijan Republic;

- determine the form and rules of issue of the certificate of conformity, hygienic, phytosanitary certificates and the veterinary certificate issued on foodstuff;

- resolve other issues following from this Decree within the competence.

3. This Decree becomes effective from the date of signing.
