1. Approve the enclosed Rules of modification of design of the wheel vehicles which are in operation and implementation of the subsequent check of fulfillment of requirements of the technical regulation of the Customs union "About safety of wheel vehicles".

2. To the Ministry of Internal Affairs of the Russian Federation till June 1, 2019 to approve administrative regulations of provision of the state service in issue of permission to modification of design of the wheel vehicle which is in operation and administrative regulations of provision of the state service in issue of the certificate on vehicle compliance with the changes made to its design to safety requirements.

3. This resolution becomes effective since June 1, 2019, the subitem "d" of Item 7 and the subitem "g" of Item 10 of the Rules approved by this resolution which except for are becoming effective since January 1, 2020.

Rules of modification of design of the wheel vehicles which are in operation and implementation of the subsequent check of fulfillment of requirements of the technical regulation of the Customs union "About safety of wheel vehicles"

1. These rules establish procedure for modification of design of the wheel vehicles which are in operation and implementation of the subsequent check of fulfillment of requirements of the technical regulation of the Customs union "About safety of wheel vehicles" (further - the technical regulation).

2. In these rules:

a) the wheel vehicles which are in operation are understood as the vehicles registered in State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation (further respectively - the State traffic inspectorate, vehicles);

b) the test laboratory (center) is understood as the organization accredited on work on assessment of conformity to requirements of the technical regulation of the corresponding categories of vehicles with the changes made to their design, which is carrying out assessment works of compliance of products to requirements of the technical regulation after its release in the address in the form of assessment of technical condition (engineering certification) or inspection and included in the unified register of conformity assessment bodies of the Eurasian Economic Union according to Procedure for inclusion of accredited bodies on assessment of conformity (including certification bodies, test laboratories (centers) in the unified register of conformity assessment bodies of the Eurasian Economic Union, and also its forming and maintaining, the approved decision of Council of the Eurasian economic commission of December 5, 2018 No. 100.

3. In cases, stipulated in Item the 77th the technical regulation, performing procedures (actions) provided by these rules is not required.

4. Modification of design of the vehicle is performed after obtaining in division of the State traffic inspectorate to which obligations on provision of the corresponding state service, permissions to modification of vehicle design (further - permission) with the subsequent check of the State traffic inspectorate of fulfillment of requirements of the technical regulation by division (further - check) and issue of the certificate on vehicle compliance with the changes made to its design to safety requirements are assigned (further - the certificate).

5. For receipt of permission the vehicle owner or his authorized representative submits the following documents to division of the State traffic inspectorate:

a) statement for issue of permission;

b) passport of the citizen of the Russian Federation or other identity document;

c) the power of attorney, the agreement or other document certifying powers of the authorized representative on representation of interests of the vehicle owner (for the authorized representative);

d) the conclusion of preliminary technical expertize of design of the vehicle regarding possibility of introduction in it of changes conforming to requirements to its content according to appendix No. 1 (further - the conclusion), issued by test laboratory (center).

6. The division of the State traffic inspectorate performs verification of the documents submitted according to Item 5 of these rules and by its results issues permission or refuses its issue with indication of causes of failure.

7. The decision on refusal in issue of permission is made in the following cases:

a) documents, stipulated in Item 5 these rules, are provided not in full;

b) documents, stipulated in Item 5 these rules, do not conform to requirements of the legislation of the Russian Federation, contain unreliable information, have counterfeit signs, and also are in number of the lost (kidnapped persons);

c) the conclusion is issued by the test laboratory (center) which is not conforming to the requirements specified in Item 2 of these rules;

d) the conclusion contains the data contradicting safety requirements to the vehicles established by the technical regulation;

e) the conclusion is absent in the register of the conclusions of preliminary technical expertize of design of the vehicle regarding possibility of modification, protocols of check of safety of design of the vehicle after the changes made to it, the procedure for forming and which maintaining is established by the Ministry of Economic Development of the Russian Federation (further - the register);

e) in the conclusion there are data on the planned changes of design of the vehicle which will entail carrying out its assessment of conformity according to requirements of Section 2 of Chapter V of the technical regulation and the following changes:

destruction of identification number;

increase in the permitted maximum weight and (or) change of base if there is no approval like the vehicle with similar characteristics;

replacement of body (parts of body) of the car or the bus, cabin (parts of cabin) of the cargo vehicle and (or) the vehicle chassis by body (part of body), cabin (part of cabin) and (or) the chassis which are not provided by brand of the vehicle;
