Some questions of cross-border movement of currency values by physical persons

According to part one of article 8 of the Law of Ukraine "About currency and currency transactions" and parts six of Article 257 of the Customs code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve form of the declaration form of cross-border movement of currency values by physical persons (further - the declaration of cross-border movement) according to appendix.

2. Determine that declaration forms of cross-border movement can be made by physical persons by listing using means of the computer equipment or their copying on paper of the A4 format (210 x 296 millimeters) in the form approved by this resolution.

3. Bring in resolutions of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 431 "About approval of form of the customs declaration for written declaration of goods, moved through customs border of Ukraine with citizens for the personal, family and other needs which are not connected with implementation of business activity" (The Official Bulletin of Ukraine, 2012, No. 40, the Art. 1526) and of May 21, 2012 No. 450 "The questions connected using customs declarations" (The Official Bulletin of Ukraine, 2012, No. 40, the Art. 1545, No. 91, the Art. 3674) changes which are applied.

4. To the public fiscal service:

provide customs of the Public fiscal service with declaration forms of cross-border movement in the form approved by this resolution, and the customs declaration for written declaration of goods moved through customs border of Ukraine with citizens for the personal, family and other needs which are not connected with implementation of business activity in the form approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 431 (The Official Bulletin of Ukraine, 2012, No. 40, the Art. 1526), taking into account the changes approved by this resolution in the quantity corresponding to their requirements;

promulgate on own website the declaration form of cross-border movement in the form approved by this resolution and provide possibility of its listing using means of the computer equipment.

5. This resolution becomes effective from the date of its publication.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 431 and 450

1. Item 3.1 of Section 3 of the customs declaration for written declaration of goods, moved through customs border of Ukraine with citizens for the personal, family and other needs which are not connected with implementation of the business activity approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 431, to exclude.

2. In the Provision about customs declarations approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 450:

Item 2 after the paragraph of the fifth to add 1) with the new paragraph of such content:

"or declarations of cross-border movement of currency values by physical persons;".

Item 8 to add 2) with the paragraph of the following content:

"For declaring of cross-border movement of currency of Ukraine by physical persons, foreign currency and bank metals in the amount equal or 10 thousand euros exceeding equivalent, and also for written declaring by physical persons of the payment documents and securities (shares, bonds, coupons to them, bills of exchange (bills of exchange), debentures, letters of credit, checks, bank orders, deposit certificates, other financial and bank documents) expressed in currency of Ukraine in the foreign currency or bank metals which total invoice cost exceeds the sum determined by the Customs code of Ukraine for written declaration of goods moved with citizens are used the declaration specified Item in paragraph six 2 this provision.".
