Declare invalid the order of the Minister of national economy of the Republic of Kazakhstan of February 25, 2015 No. 135 "About approval of Health regulations "Sanitary and epidemiologic requirements to production, realization and storage of perfumery and cosmetic products and means of hygiene of oral cavity" (registered in the Register of state registration of regulatory legal acts under No. 10623 published on May 22, 2015 in the Information system of law of Ad_let).

3. To provide to committee of protection of public health of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Tsoi A. V.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Health regulations "Sanitary and epidemiologic requirements to production, realization and storage of perfumery and cosmetic products"

Chapter 1. General provisions

1. These Health regulations "Sanitary and epidemiologic requirements to production, realization and storage of perfumery and cosmetic products" (further - Health regulations) are developed according to the subitem 2) of Item 1 of Article 7-1, Item 6 of Article 144, of Item 1 and Item 2 of article 145 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code) and contain sanitary and epidemiologic requirements to the choice of the parcel of land, designing, reconstruction, production, storage and realization of perfumery and cosmetic products.

2. In these Health regulations the following terms and determinations are used:

1) expiration date - the period after which perfumery and cosmetic products are considered unsuitable for proper use. The expiration date is established by the manufacturer of products in technical documents.

2) perfumery and cosmetic products (further - PKP) - the substance or mixes of substances intended for drawing is direct on external cover of the person (skin, indumentum, nails, lips and genitalia) or on teeth and mucous membrane of oral cavity with the single or main goal of their clarification, change of their appearance, giving of pleasant smell, and (or) correction of smell of body, and (or) protection, and (or) preserving in good shape, and (or) care of them.

In these Health regulations the terms which are not determined in this Chapter are used in the values established by the Code, the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (further - TR CU 009/2011).

Chapter 2. Sanitary and epidemiologic requirements to the choice of the parcel of land, designing and reconstruction of facilities for production of perfumery and cosmetic products.

3. The choice of the parcel of land of facilities for production of PKP is determined taking into account requirements of the health regulations and hygienic standard rates approved by state body in the sphere of sanitary and epidemiologic wellbeing of the population according to Item 6 of Article 144 and article 145 of the Code and requirements of the state standard rates in the field of architecture, town planning and the construction approved by authorized body for architecture, town planning and construction according to subitem 23-16) of article 20 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan".

The legal entities and physical persons performing activities for production of PKP notify territorial authority in the sphere of sanitary and epidemiologic wellbeing of the population on the beginning of activities according to Item 30 of appendix 3 and article 17 of the Law of the Republic of Kazakhstan of May 16, 2014 "About permissions and notifications".

4. In case of the choice of the parcel of land under construction placement of facilities for production of PKP on the parcels of land is not allowed:

1) used under cattle mortuaries, places of burial of toxic waste, dumps, navozokhranilishch, fields of cesspool cleaning, the cemetery, and also having pollution of the soil of organic and chemical nature;

2) in case of excess of standard rates of radiation safety;

3) Items, being the soil centers stationary and unsuccessful on anthrax;

4) in the first zone of sanitary protection of sources of water supply;
