According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity is estimated and frequency of holding planned actions of the state supervision (control) in the field of protection of the surrounding environment, rational use, reproduction and protection of natural resources by the State ecological inspectorate which are applied is determined.

1-1. Determine that frequency of conducting checks of observance by the operator of installation of conditions of the integrated ecological permission is determined on the basis of systematic risks assessment for the environment given in criteria by which the risk degree from implementation of economic activity is estimated and frequency of holding planned actions of the state supervision (control) in the field of protection of the surrounding environment, rational use, reproduction and protection of the natural resources by the State ecological inspectorate approved by this resolution taking into account the following features is determined:

the systematic risks assessment for the environment is performed concerning each installation separately;

reference of installation to high, average or insignificant risk degree is performed taking into account score, added by all criteria determined in appendix 2 to criteria by which the risk degree from implementation of economic activity is estimated and frequency of holding planned actions of the state supervision (control) in the field of protection of the surrounding environment, rational use, reproduction and protection of the natural resources by the State ecological inspectorate approved by this resolution for the scale given in item 4 of the specified criteria is determined;

frequency of conducting checks of observance by the operator of installation of conditions of the integrated ecological permission is determined taking into account risk level of installation and makes: for installations with high risk - once a year that corresponds to the highest risk level, and for installations with average or with insignificant risk degree - once in three years that corresponds to the lowest risk level.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of March 19, 2008 No. 212 "About approval of criteria of distribution of subjects of managing on risk degree of their economic activity for the surrounding environment and frequency of implementation of actions of the state supervision (control)" (The Official Bulletin of Ukraine, 2008, No. 23, the Art. 686).

Criteria by which the risk degree from implementation of economic activity is estimated and frequency of holding planned actions of the state supervision (control) in the field of protection of the surrounding environment, rational use, reproduction and protection of natural resources by the State ecological inspectorate is determined

1. To criteria by which the risk degree from implementation of economic activity is estimated and frequency of holding planned actions of the state supervision (control) in the field of protection of the surrounding environment, rational use, reproduction and protection of natural resources by State ecoinspectorate is determined, belong:

1) implementation of economic activity with observance of ecological requirements;

2) category of types of the planned activities and objects which can have considerable environmental impact and types of activity which production requires receipt of the integrated ecological permission;

3) types of violations of the requirements of the legislation in the field of environmental protection revealed by results of the events of the state supervision (control) held within the last five years preceding planning period;

4) the number of violations of the requirements of the legislation in the field of environmental protection revealed by results of the events of the state supervision (control) held within the last five years preceding planning period;

5) the number of the unplanned events of the state supervision (control) held concerning the subject of managing within the last five years preceding planning period on the bases provided by paragraphs  to the third, seventh, ninth part one of article 6 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity";

6) quantity of cases of not admission the subject of managing of officials of state supervision body (control) to holding actions of the state supervision (control) (except cases, the stipulated in Article 10 Laws of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity") in the field of protection of the surrounding environment, rational use, reproduction and protection of natural resources within the last five years preceding planning period.

2. Risks of approach of negative effects from implementation of economic activity in the field of protection of the surrounding environment, rational use, reproduction and protection of natural resources are determined in appendix 1.
