ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About enforcement of provisions of the Law No. 270/2018 on single system of compensation in the budget sphere

(as amended on 30-08-2023)

For the purpose of the organization of execution of provisions of the Law No. 270/2018 on single system of compensation in the budget sphere (The official monitor of the Republic of Moldova, 2018, Art. No. 441-447, 715) DECIDES: the Government

1. Approve:

1) Criteria and procedure for reference of some budget units to categories of organizations according to field of activity, according to appendix No. 1;

2) Regulations on procedure for determination of length of service for establishment of steps of compensation, according to appendix No. 2;

3) Standard regulations on procedure for establishment of the allowance for achievements to personnel of budget units, according to appendix No. 3;

4) Regulations on types and procedure for establishment of special allowances, according to appendix No. 4;

5) Rules of calculation of hour rate for the personnel which are engaged in pedagogical activities in all industries of national economy according to appendix No. 5;

6) the Procedure of payments of the average monthly salary considered in case of determination of wage differential, and compensation payments according to appendix No. 6;

7) Changes which are made to some orders of the Government, according to appendix No. 7;

8) Regulations on procedure for system assessment and revaluation of positions in the budget sphere, according to appendix No. 9.

9) Regulations on procedure for calculation and payment of annual bonus to workers of budget units, according to appendix No. 10;

10) Standard regulations on procedure for establishment of the allowance to personnel of the central administrative authorities subordinated to the Government, the administrative authorities subordinated to the ministries, and autonomous administrative authorities for realization of priority tasks in the context of fulfillment of requirements on accession to the European Union, according to appendix No. 11.

2. Recognize invalid some orders of the Government according to appendix No. 8.

3. To bodies of the public power in 5-day time of the date of entry into force of this resolution to approve domestic situations about establishment of the allowance for achievements and special allowances.

4. This resolution becomes effective from the date of publication.

5. The salary of personnel of budget units will be calculated for all December, 2018 according to provisions of this resolution.

Regulations on procedure for determination of length of service for establishment of steps of compensation

1. This Provision provides the procedure of determination of length of service for establishment of steps of compensation according to length of service, depending on employee category of the budget sector.

2. In case of determination of length of service for establishment of steps of compensation for government employees, including employees with special status as a part of the State Tax Administration, Customs Service, diplomatic service, National authority on integrity and Services according to the prevention and anti-money laundering, length of service in public service which includes is considered:

1) the periods of the actual accomplishment of the state positions specified in the Single qualifier of government employees or government employees with special status as a part of the State Tax Administration, Customs Service, diplomatic service, National authority on integrity and Services according to the prevention and anti-money laundering;

2) the activities periods as government employees in the public authorities operating in the territory of the Republic of Moldova before entry into force of the Law No. 158/2008 on the state position and the status of the government employee;

3) the periods, during which the government employee:

a) did not work actually, but behind it the position and the salary, fully or partially remained;

b) it was suspended from position according to part provisions (1) Articles 38, of Items c) - e) Article 52 or Item b) parts (1) article 54 of the Law No. 158/2008 on the state position and the status of the government employee;

c) it was suspended from position according to Items b) and c) article 53 of the Law No. 158/2008 on the state position and the status of the government employee and subsequently it was exempted from disciplinary or criminal liability;

d) by force was absent from work in connection with illegal release or dismissal and subsequently it is recovered after pronouncement of the relevant decision by court;

e) it was recalled according to article 47 of the Law No. 158/2008 on the state position and the status of the government employee;

4) the periods, during which the government employee:

a) at least 2 years held positions of officers of bodies of national defense, state security and public order;

b) at least 5 years worked at the companies, organizations or the organizations as the head or the specialist in the area connected with activities profile on the state position to which it was appointed.

3. In case of determination of length of service for establishment of step of the compensation corresponding to length of service for positions with special status including government employees with special status within national defense, public order and state security, the next periods are considered:

1) the activities periods in positions with special status, including in what the government employee did not work with special status, but remained on the state position with special status, with preserving the average salary, fully or partially;

2) the periods in which persons, held positions with special status, including government employees with special status:

a) passed special service, military service (under the contract and conscription service) in law-enforcement bodies, armed forces, the state security agencies, bodies of the emergency situations and other military forming (special) created according to the legislation of the Republic of Moldova;

b) performed activities in State department of the Republic of Moldova for military questions;

c) served in bodies of national defense, state security, public order both on officers positions, and as a part of agents/troops/sergeants/subofficers;

d) served in law-enforcement bodies, in armed forces, in the state security agencies and in bodies for emergency situations of the former USSR;

e) served in law-enforcement bodies, in armed forces, in the state security agencies and in bodies for emergency situations of other states based on international conventions and agreements which party the Republic of Moldova is;

f) performed activities on the state position, on responsible state position, and also on contractual basis in the ministries and departments, civil organizations and the organizations with preserving on active military service or in states of personnel of the state security agencies, law-enforcement bodies, bodies of the National center for fight against corruption and systems of penitentiary administration;

g) performed activities for the contract in penal institutions;

h) were in captivity if it was not voluntarily and if person which is in captivity did not commit crime against the Republic of Moldova;

i) were in custody and served sentence owing to unreasonable criminal prosecution or repressions and subsequently were rehabilitated;

j) studied in educational institutions in the field of military, state security and public order at stationary training, except for the periods of training of the highest and professional in educational institutions which include secondary education;

k) than spheres of military science, safety and public order studied at stationary training, at the rate of 6 months of office years of service in one year of training, but no more than five years of training in institutions of higher education in various spheres, others;

l) performed activities in the civil industries connected with specialty of post at the rate of one year of office years of service in two years of work, but no more than 10 years of service length;

m) were called on military charges or are mobilized, including in connection with participation in mobilization and in military operations on protection of integrity and independence of the Republic of Moldova during the period from March 2, 1992 to August 13, 1992;

n) performed other types of activity which are directly provided by the existing regulations;

3) the service period as the officer of information joins in general working life, in special working life, in length of service in public service, and also in the years of service granting the right to determination of length of service for establishment of steps of compensation irrespective of time which passed between date of dismissal and date of employment;

4) in case of repeated transfer / employment to the state position with special status – the entire periods calculated earlier, and also, as necessary, other periods.
