ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About features of crossing by the Russian and foreign vessels of frontier of the Russian Federation at the sea

(as amended on 24-09-2024)

According to article 9.1 of the Law of the Russian Federation "About Frontier of the Russian Federation" the Government of the Russian Federation decides:

1. Establish the following cases in which vessels can repeatedly cross frontier of the Russian Federation at the sea without passing boundary, customs (regarding making of the customs transactions connected with arrival (departure) of courts) and other types of control:

a) for the courts specified in the subitem "an" of Item 1 of article 9.1 of the Law of the Russian Federation "About Frontier of the Russian Federation":

departure of the Russian courts from the Russian ports for the purpose of merchant shipping in internal seawaters, in territorial sea, exclusive economic zone and (or) on the continental shelf of the Russian Federation with the subsequent arrival in the Russian ports;

navigation of foreign vessels between the Russian ports, and also their departure from the Russian ports in internal seawaters or in territorial sea of the Russian Federation for the purpose of merchant shipping, except for the activities connected with use of courts for fishery with the subsequent arrival in the Russian ports;

navigation of the Russian and foreign vessels between the Russian ports with calling territorial seas of foreign states in case of pass through the Baltic, Okhotsk or Japanese seas and passages adjoining them, and also the Kattegat Straits and Skagerak;

departure of the Russian icebreaker ships from the Russian ports in the exclusive economic zones and (or) territorial seas of foreign states located in the Baltic, Okhotsk and Japanese seas for implementation of icebreaker assistance with the subsequent arrival in the Russian ports;

departure of foreign vessels from the Russian ports in exclusive economic zone of the Russian Federation for the purpose of implementation of sea scientific research with the subsequent arrival in the Russian ports;

departure of foreign vessels from the Russian ports on the continental shelf of the Russian Federation for the purpose of performance of works on search, investigation and development of fields of hydrocarbon raw materials on the continental shelf of the Russian Federation, ensuring functioning of the offshore floating platforms registered under National flag of the Russian Federation and also for the purpose of creation, operation and use of artificial islands, installations and constructions, including offshore stationary platforms, on the continental shelf of the Russian Federation with the subsequent arrival in the Russian ports;

departure of foreign sports sailing ships from the Russian ports for participation in competitions in sailing to the subsequent arrival in the Russian ports;

departure of the Russian courts from the Russian ports located in the Arctic zone of the Russian Federation, for the purpose of merchant shipping in the Arctic Ocean and the seas entering it with the subsequent arrival in the Russian ports located in the Arctic zone of the Russian Federation;

b) for the courts specified in the subitem "b" of Item 1 of article 9.1 of the Law of the Russian Federation "About Frontier of the Russian Federation":

swimming through territorial sea of the Russian Federation without the purpose of calling the Russian ports with the subsequent departure from the territory of the Russian Federation;

calling of the Russian courts internal seawaters and territorial sea of the Russian Federation for overload of catch of the water biological resources got (caught) in the areas determined by the Government of the Russian Federation, and which are subject to delivery to the territory of the Russian Federation in case of the adverse hydrometeorological conditions which is not allowing to perform overload of catch of water biological resources outside territorial sea of the Russian Federation.

2. Determine that requirements to the vessel equipment, specified in Item 1 of article 9.1 of the Law of the Russian Federation "About Frontier of the Russian Federation", the technical means of control providing constant the automatic not adjusted information transfer about location of the vessel and other technical means of control of location of courts on condition of which accomplishment these vessels can repeatedly cross frontier of the Russian Federation at the sea without passing boundary customs (regarding making of the customs transactions connected with arrival (departure) of courts) and other types of control, are determined by the Ministry of Transport of the Russian Federation in coordination with Federal Security Service of the Russian Federation, except for vessels of the fishery fleet, and the Ministry of Agriculture of the Russian Federation in coordination with Federal Security Service of the Russian Federation concerning vessels of the fishery fleet.

3. Approve enclosed:

Rules of the notification of boundary bodies of the Federal Security Service about intention to perform numerous crossing of frontier of the Russian Federation at the sea by the Russian courts;

requirements to implementation by the Russian courts which passed boundary, customs and other types of control in case of departure from the territory of the Russian Federation, arriving to the territory of the Russian Federation without the purpose of calling the Russian ports with the subsequent departure from the territory of the Russian Federation, overload of catch of water biological resources if adverse hydrometeorological conditions does not allow to perform such overload outside territorial sea of the Russian Federation;

changes which are made to acts of the Government of the Russian Federation.

4. Recognize invalid:

the order of the Government of the Russian Federation of February 9, 2012 No. 107 "About crossing of frontier of the Russian Federation by the Russian courts for overload of catch of water biological resources, fish and other products from them in internal seawaters and in territorial sea of the Russian Federation" (The Russian Federation Code, 2012, No. 8, the Art. 1023);

the order of the Government of the Russian Federation of April 15, 2014 No. 340 "About permission to calling of courts territorial seas of foreign states" (The Russian Federation Code, 2014, No. 18, the Art. 2183);

the order of the Government of the Russian Federation of June 5, 2014 No. 518 "About procedure for determination of requirements to the vessel equipment the technical means of control providing permanent automatic information transfer about location of the vessel and (or) other technical means of control of location of the vessel" (The Russian Federation Code, 2014, No. 24, the Art. 3093);
