No. 171-174, 777) DECIDES: the Government

1. Reorganize by transformation the state company "The State Assay Chamber under the Ministry of Finance" into public organization "State Assay Chamber".

2. To the Ministry of Finance to perform function of the founder of public organization "State Assay Chamber".

3. the public organization "State Assay Chamber" is successor of the rights and obligations of the state company "The State Assay Chamber under the Ministry of Finance".

4. To transfer property of the state company "The State Assay Chamber under the Ministry of Finance" to public organization "State Assay Chamber" according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015.

5. According to the existing regulations, the state company "The State Assay Chamber under the Ministry of Finance" to transfer the carried-out functions and the provided services to public organization "State Assay Chamber" with ensuring compliance with provisions of the Law No. 133/2011 on personal data protection.

6. To perform release of personnel in connection with reorganization of the state company "The State Assay Chamber under the Ministry of Finance" according to normative provisions in the field of work in case of impossibility of its translation.

7. Before appointment of the director of public organization "State Assay Chamber" the Minister of Finance according to the charter function of the director of the relevant organization will be temporarily performed by the administrator of the state company "The State Assay Chamber under the Ministry of Finance" which is in process of reorganization which will take all measures necessary for carrying out reorganization according to provisions of this resolution.

8. Approve:

1) the Charter of public organization "State Assay Chamber", according to appendix No. 1;

2) Structure of public organization "State Assay Chamber", according to appendix No. 2;

3) Changes which are made to some orders of the Government, according to appendix No. 3.

9. Establish the extreme number of staff of public organization "State Assay Chamber" in number of 26 units with the annual salary fund according to the legislation.

10. to public organization "State Assay Chamber":

1) in a month from registration date of changes in the Agency of the state services to provide transfer of remaining balance of financial resources from the bank accounts opened addressed to suppliers of paid services for the accounts opened on the single treasurer account of the Ministry of Finance. After this term to use the accounts opened on the single treasurer account of the Ministry of Finance in activities. In case of availability of term deposits on bank accounts according to which contracts by the reorganized organization before the date of entry into force of this resolution are signed, to public organization "State Assay Chamber" to keep the existing term bank deposits before full implementation of contractual commitments on deposits;

2) within 2 months from the effective date of this resolution to organize carrying out tender at the choice of the director of public organization "State Assay Chamber".

11. To impose control over the implementation of provisions of this resolution on the Ministry of Finance.

12. This resolution becomes effective from the date of publication.

Appendix No. 3

to the Order of the Government of the Republic of Moldova of February 27, 2019 No. 112

Changes which are made to some Orders of the Government

1. In the Rules of buying up at the population of precious metals, gemstones in products and scrap approved by the Order of the Government No. 769/1995 (1996, Art. No. 2-3, 12) to bring the official monitor of the Republic of Moldova in the following changes:

in Item 13 of the word "The state assay chamber under the Ministry of Finance" shall be replaced with words public organization "State Assay Chamber";

in Item 21 of the word of "The state company" shall be replaced with words "Public organization", and to replace the word of "company" with the word of "organization".

In Item 20 of the Regulations on accounting treatment, assessment and the realization of the confiscated, ownerless property arrested perishable or with limited storage duration of products, physical evidences, the property which passed on inheritance right to the state, and treasures approved by the Order of the Government No. 972/2001 (The official monitor of the Republic of Moldova, 2001, Art. No. 112-113, 1021) of the word "state company" shall be replaced with words "Public organization".
