About procedure for the organization and approval of holding fairs

Based on Item 5 of article 15 of the Law of the Republic of Belarus of January 8, 2014 "About state regulation of trade and public catering" the Council of Ministers of the Republic of Belarus DECIDES: No. 128-Z

1. Approve Regulations on procedure for the organization and approval of holding fairs in the territory of the Republic of Belarus it (is applied).

2. No. 349 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 09.07.2026

3. Provide to the Ministry of anti-monopoly regulation and trade the right to make explanations about procedure for application of the Regulations on procedure for the organization and approval of the holding fairs in the territory of the Republic of Belarus approved by this resolution.

4. No. 349 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 09.07.2026

5. To the republican state bodies, other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk Gorispolkom to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

6. Operation of this resolution does not extend to the fairs approved before entry into force of this resolution irrespective of the planned time of their carrying out. Such fairs are held according to the legislation existing before entry into force of this resolution.

7. This resolution becomes effective in three months after its official publication, except for items 4 and 5, becoming effective after official publication of this resolution.

Regulations on procedure for the organization and approval of holding fairs in the territory of the Republic of Belarus

1. This Provision determines procedure for the organization and approval of holding fairs in the territory of the Republic of Belarus.

2. For the purposes of this provision terms in the values established by the Law of the Republic of Belarus "About state regulation of trade and public catering" and also the following terms and their determinations are used:

foreign fair - the fair organized in the territory of the Republic of Belarus in which only nonresidents of the Republic of Belarus take part;

the international fair - fair in which at least 10 percent of nonresidents of the Republic of Belarus from total number of participants participate;

the place for sales of goods (performance of works, rendering services) at fair - the part of the territory of fair provided to the participant of fair for sales of goods (performance of works, rendering services);

the organizer of fair (further - the organizer) - state body, the Belarusian Chamber of Commerce and Industry, public organization (consolidation), consolidation of legal entities and (or) individual entrepreneurs (association, the union), other legal entity, the individual entrepreneur performing the organization and (or) management of fair;

regional fair - fair which participants are legal entities and physical persons, including individual entrepreneurs, one or several areas of the Republic of Belarus and (or) Minsk;

republican fair - fair which participants are legal entities and physical persons, including individual entrepreneurs, all areas of the Republic of Belarus and Minsk;

the co-organizer of fair (further - the co-organizer) - state body, the Belarusian Chamber of Commerce and Industry, public organization (consolidation), consolidation of legal entities and (or) individual entrepreneurs (association, the union), other legal entity, the individual entrepreneur involved by the organizer based on the agreements signed with them or according to administrative documents of superior organization to accomplishment of separate functions on the organization of fair;

specialized fair - the fair oriented to certain target audience within which goods are implemented (works are performed, services are rendered) in one subject;

scope of fair - the industries or allied industries of economy, the sphere of scientific, cultural, social life of society determined by the organizer to which the list of the groups or types of the goods (the works, services) realized (which are carried out, rendered belongs) at fair;

the technical operator - the legal entity, the individual entrepreneur involved by the organizer (co-organizer) based on the signed agreements to technical supply and field service of fair;

the fair territory - the land area, capital structure (the building, construction), the isolated room or their parts, on (to) whom is carried out fair;

universal fair - the fair oriented to wide range of persons within which goods are implemented (works are performed, services are rendered) in different subjects;

the participant of fair - the legal entity, physical person, including the individual entrepreneur providing information on goods (works, services), performing sales of goods (the performing works rendering services) within scope of fair.

3. Fairs are by the form subdivided on foreign, international, republican and regional, on subject - on specialized and universal.

3-1. Under the organization and holding fair the organizer of fair:

provides places for sales of goods (performance of works, rendering services) at fair (except for foreign and international fairs) their producers;

establishes requirements to appearance of places for sales of goods (performance of works, rendering services) at fair;

at least five participants of fair provide participation in one fair, except as specified, when the fair is held according to the decision of state body.

The term of holding one fair cannot be more than 30 calendar days in a row.

4. Approval of holding fairs is performed city (including the Minsk city), district executive committees, administration of the industrial park "Great Stone" (further – authorized body) in the place of their carrying out.

Fairs which organizer are city (including Minsk city) district executive committees, are held according to the decision of the relevant executive committee without observance of reconciliation procedure of their carrying out.

5. For review holding fair the organizer no later than 30 calendar days prior to the fair represents to the relevant authorized body in writing during acceptance, the courier (courier), by means of mail service or electronically through the single portal of electronic services by means of the nation-wide automated information system the statement for approval of holding fair and the document confirming the consent of the owner of the parcel of land, capital structure (the building, construction), the isolated room or their part (further – real estate) on carrying out on (to) them fairs.

The consent of the owner of real estate to holding fair is not represented if:

the owner of real estate, in (on) which plans holding fair, the organizer is;

the owner of real estate, in (on) which plans holding fair, the authorized body is;

the organizer signed the lease agreement (free use) with the owner of real estate who provides for validity the organization of fairs with use of real estate, in (on) which holding fair is planned;

the fair is held on lands public.

6. Data are specified in the statement for approval of holding fair:

6.1. about the organizer:

full name of the legal entity, surname, own name, middle name (if that is available) the individual entrepreneur;

location of the legal entity, residence of the individual entrepreneur;

numbers of contact telephone numbers, e-mail address (in the presence);

information on the head of the legal entity (persons, representatives to represent the interests of the legal entity);

6.2. about fair:

name, type and scope of fair;

the list of groups and (or) types of goods (works, services) assumed to sale (accomplishment, rendering) at fair;

the carrying out period with indication of start and end date of fair;

venue address;

operating mode;

the planned number of participants of fair;

the planned number of places for sales of goods (performance of works, rendering services) at fair their producers;

the description of registration of appearance of places for sales of goods (performance of works, rendering services) at fair;

6.3. the corporeal rights to real estate object, in (on) which holding fair is planned (with indication of the owner of real estate object), liability laws on real estate object, in (on) which holding fair, the organizer is planned (with indication of the term of ownership and (or) use of real estate object).

7. In need of approval of holding several fairs the documents specified in Item 5 of this provision are represented separately on each fair.

8. Authorized body within 10 days from the date of submission of documents specified in Item 5 of this provision:

approves holding fair or refuses approval;

notifies the organizer on approval of holding fair or on refusal in approval.

9. The authorized body refuses approval of holding fair in the cases determined in article 25 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures" and also:

in case of non-compliance with the documents by the organizer of submission due date specified in part one of Item 5 of this provision;

in case of discrepancy to the requirements specified in paragraph four of the part one and part two of Item 3-1 of this provision planned to holding fair;

if the venue of fair creates threat of public safety, damnification of life, to health of citizens, property of legal entities or physical persons;

if holding fair matches on time and the venue with other fair, the application for approval of which holding is submitted earlier, with cultural or other action which holding is earlier planned by local executive and administrative organ;

in case of numerous (two and more times within 12 months in a row preceding month of filing of application about approval of holding fair) violation by the organizer of requirements of this provision, other requirements of the legislation under the organization and (or) holding fair.

10. The organizer has the right to refuse holding fair, having in writing informed authorized body and having notified on it participants of fair not later than three days prior to its carrying out.

11. The organizer provides the organization and holding fair independently or attracts according to the legislation to these purposes of the co-organizer and (or) technical operator.

12. State bodies, the Belarusian Chamber of Commerce and Industry according to the competence of case of the address of the organizer, and also public organization (consolidation), consolidation of the legal entities and (or) individual entrepreneurs (association, the union) interested in holding fair, but who are not her organizer in case of determination that the level of fair corresponds to interests of development and increase in efficiency of industries of economy, it is directed to assistance to domestic producers, other legal entities and individual entrepreneurs in promotion of their goods (works, services) on the domestic market, can:

prepare the relevant decision directed to increase in level of fair, forming of organizing committee of fair and coordination of activities of the interested state bodies for its carrying out;

render assistance in attraction of domestic producers, other legal entities and physical persons, including individual entrepreneurs, to participation in fair;

render assistance to producers, other legal entities and physical persons, including individual entrepreneurs, in participation in fair;

distribute information on the supported fair.

13. The organizer shall:

observe, and also take measures for observance by participants of fair of requirements of the legislation in the field of trade, consumer protection, and also general requirements of fire safety, sanitary and epidemiologic requirements, requirements in the field of environmental protection, requirements in the field of veterinary science to content and operation of capital structures (buildings, constructions), the isolated rooms and other objects belonging to subjects of managing;

fulfill legal requirements of staff of the law-enforcement bodies and representatives of the public who are carrying out obligations on protection of public order at fair and to assist them in ensuring public order;

observe other requirements of the legislation.

In case holding fair provides change of the organization or prohibition of traffic, the organizer shall develop and approve in accordance with the established procedure with the interested state bodies and other organizations, divisions of the State automobile inspection of the Ministry of Internal Affairs the project documentation on installation of technical means of the organization of traffic.

14. At the fairs held in capital structures (buildings, constructions), the isolated rooms or their parts, in the place, available to buyers, the following information is placed:

name and operating mode of fair;

location of the book of notes and proposals of the organizer;

numbers of contact telephone numbers of the organizer, the territorial authorities of the Ministry of anti-monopoly regulation and trade, the Ministry of Taxes and Tax Collection, bodies and organizations exercising the state sanitary inspection, bodies of veterinary supervision, internal affairs;

full name and the location of legal entities - participants of fair if participant of fair is the individual entrepreneur or physical person - surname, own name, middle name (if that is available).

15. In the territory of fair finding of the automobile and load road transport which is not intended for servicing or the organization of fair, except for specialized fairs selling vehicles, construction and large-size goods, and also agricultural products, fish is forbidden.
