About approval of the Regulations on workers who perform service functions in bodies of diplomatic service

According to part four of article 8 of the Law of Ukraine "About diplomatic service" PRIKAZYVAYU:

1. Approve such which are applied:

Regulations on workers who perform service functions in bodies of diplomatic service;

The list of positions of workers which perform service functions in bodies of diplomatic service;

Standard form of the contract with workers who perform functions on servicing in the office of the Ministry of Foreign Affairs of Ukraine and representations the MFA in the territory of Ukraine;

Standard form of the contract with workers who perform service functions in foreign diplomatic organizations of Ukraine.

2. Declare invalid the order of the Ministry of Foreign Affairs of Ukraine of May 24, 2017 No. 219 "About approval of the Regulations on service personnel of system of bodies of diplomatic service of Ukraine and the List of positions of workers of service personnel of system of bodies of diplomatic service of Ukraine", registered in the Ministry of Justice of Ukraine on June 16, 2017 for No. 751/30619.

3. To provide to department of management of personnel submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. This order becomes effective from the date of its official publication.

5. To impose control of execution of this order on the State secretary the MFA.

Regulations on workers who perform service functions in bodies of diplomatic service

1. This Provision determines the status of workers who perform service functions in bodies of diplomatic service (further - service personnel), their functions, and also feature of realization of employment legal relationship, work-related service personnel.

2. The relations arising in connection with realization of this provision are regulated by the Constitution of Ukraine, the Labor code of Ukraine, the Law of Ukraine "About diplomatic service", other regulatory legal acts adopted according to them, and also existing with international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine.

3. Service personnel are employees of bodies of diplomatic service to whom functions on servicing of bodies of diplomatic service are assigned, namely:

complex servicing and repair of buildings and constructions, work on content of the adjacent territory, restoration and installation and construction works;

documentary providing and clerical work (except documents with limited access);

computer ensuring and implementation of information technologies (except workers whose competence includes administration and development of nation-wide electronic registers, databases, information systems, and also ensuring information security);

accomplishment of tasks and functions of the specialist in interviewing;

accomplishment of functions of interpretation and translation, secretary, computer typing, work with the copy and multiplying equipment, record and processing of digital and other data, matching of reference and information material;

maintaining archive;

material and economic providing;

servicing and operation of vehicles and processing equipment;

control of vehicles;

safety of property;

cleaning of houses and the territories adjoining to them, service premises, accomplishment of other economic works.

The list of positions of workers of the device the MFA and representations the MFA in the territory of Ukraine which perform functions on servicing is determined according to Criteria of determination of the list of positions of employees of state bodies which perform service functions, approved by the resolution of the Cabinet of Ministers of Ukraine of April 06, 2016 No. 271.

4. The service personnel works at established posts of bodies of diplomatic service on contractual basis.

5. The service personnel of the device the MFA and representations the MFA in the territory of Ukraine is created of number of citizens of Ukraine.

The list of positions of workers of the device the MFA and representations the MFA in the territory of Ukraine which perform functions on servicing affirms the central executive body which provides forming and realizes state policy in the sphere of public service, on representation of the State secretary the MFA.

The service personnel of foreign diplomatic organizations of Ukraine (further - ZDU) is created of number of citizens of Ukraine, and if necessary - also from among foreigners.

6. The list of positions of service personnel affirms as foreign diplomatic organizations of Ukraine the order the MFA based on offers of service of personnel management the MFA. Preparation of the specified list is performed by service of personnel management the MFA on the following stages:

1) determination of requirements of ZGU in number of positions the next year on the basis of standard staff lists ZGU, and also content and nature of the works performed on these positions;

2) approval by the State secretary the MFA of the list of workers of service personnel of ZDU whose duration of the contract shall be complete in subsequent period;

3) approval by the State secretary the MFA of the schedule of return of workers and carrying out selection to positions which are released during the next period.

7. Holding the posts of service personnel in bodies of diplomatic service by citizens of Ukraine is performed by employee screening.

8. Selection to positions of service personnel in bodies of diplomatic service is made by the Contest committee the MFA.

9. Requirements to professional competence of persons which apply for holding the posts of service personnel are:
