For the purpose of realization of the Safe City component of the Smart City Project, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for forming and use of the amounts of the penalties collected for making of road traffic offenses and operation of the vehicles fixed using the hardware and software within realization of the Safe City component of the Smart City Project according to appendix.

2. To the ministries, the state committees and administrative departments of the Kyrgyz Republic to take the measures following from this resolution.

3. Recommend to local government bodies:

- take the measures following from this resolution;

- bring the decisions into accord with this resolution.

4. Declare invalid the order of the Government of the Kyrgyz Republic "About approval of procedure for forming and use of the amounts of the administrative penalties collected for making of the administrative offenses fixed using the certified special control and measuring technical means working in automatic mode having functions photo and filmings, videos" of July 27, 2017 No. 453.

5. To impose control of execution of this resolution on department of finance and credit policy and department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

1. General provisions

This Procedure regulates procedure for forming, accounting and use of the amounts of the penalties collected for making of road traffic offenses and operation of the vehicles fixed using the hardware and software (further - the AIC), within realization of the Safe City component of the Smart City Project.

2. In this Procedure the following terms and concepts are applied:

tender - selection by means of which the winner on delivery of goods, works, services and consulting services according to the procedure, stipulated by the legislation in the field of public procurements is determined;

the reconciliation statement - the document reflecting condition of mutual calculations between the parties for certain period;

the administered account - the account opened in the Ministry of Finance of the Kyrgyz Republic on collection of the penalties paid for road traffic offense and operation of the vehicles fixed using the AIC within realization of the Safe City component of the Smart City Project for Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic;

the automated information system (AIS) "Safe city" - the state information system providing automation of processes of collection, storage, processing and registration of information fixed by the hardware and software and the decisions made by authorized bodies on road traffic offenses (further - traffic regulations), with display of the status of delivery/nondelivery of copies of resolutions on cases on violations of traffic regulations and payment at the central level;

the hardware and software (further - the AIC) - the stationary/portable certified control and measuring technical means having functions photo and filmings, videos, representing system on automatic provision of complex information on general flow of vehicles, the fixed violations of traffic regulations and video surveillance.

3. The contractors determined following the results of tender(s) the State committee of information technologies and bonds of the Kyrgyz Republic and Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic are provided with access in real time to information on the collected penalties through the automated information system "Safe City".

2. Procedure for forming of the amounts of penalties

In the Ministry of Finance of the Kyrgyz Republic the administered account of Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic (further - the administered account) on collection of the penalties paid for making of road traffic offenses and operation of the vehicles fixed using the AIC is opened.

5. Funds for the administered account of Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic arrive from the penalties for making of road traffic offenses which are actually paid by physical persons and legal entities and operation of the vehicles fixed using the AIC.

6. The cash accounting, the penalties which arrived from payment collected for making of road traffic offenses and operation of the vehicles fixed using the AIC is performed in automatic mode with use of the automated information system "Safe City".

7. The headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic together with the Ministry of Finance of the Kyrgyz Republic draws up the reconciliation statement by each AIC of actually arrived money into the administered account, to the 7th, monthly, for accounting of actually arrived financial resources and quantity of the paid penalties.

8. The Ministry of Finance of the Kyrgyz Republic performs allocation of necessary financial resources, from the means arriving into the administered account in first-priority procedure:

- To the state committee of information technologies and communication of the Kyrgyz Republic for implementation of calculations for actually paid penalty with contractors according to the agreements signed following the results of tender(s) and also technical operators for technical maintenance and support of the automated information system "Safe City";
