About approval of the Procedure for carrying out audit of Public service on safety issues of foodstuff and consumer protection and its territorial authorities

According to Item 8 parts one of article 5 of the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, and wellbeing of animals" the Cabinet of Ministers of Ukraine decides health:

Approve the Procedure for carrying out audit of Public service on safety issues of foodstuff and consumer protection and its territorial authorities which is applied.

Procedure for carrying out audit of Public service on safety issues of foodstuff and consumer protection and its territorial authorities

1. This Procedure determines the mechanism of carrying out external and internal audit of Gosprodpotrebsluzhby and its territorial authorities (further - audit) by carrying out periodic and independent assessment:

activities of Gosprodpotrebsluzhby and its territorial authorities when implementing the state control of observance by operators of the market of the legislation on foodstuff, sterns, health and wellbeing of animals, and also legislations on by-products of animal origin when importing (transfer) of such by-products to customs area of Ukraine;

compliance of activities of Gosprodpotrebsluzhby and its territorial authorities to tasks of the long-term plan of the state control and measures of the annual plan of the state control.

2. Audit is the tool of assessment of activities of Gosprodpotrebsluzhby and its territorial authorities regarding implementation of control measures, accomplishment of tasks of the long-term plan of the state control.

3. Task of audit is evaluating activities of Gosprodpotrebsluzhby and its territorial authorities.

4. The main criteria by which assessment of activities of Gosprodpotrebsluzhby and its territorial authorities is carried out are:

1) efficiency of implementation of the state control during production and turnover of foodstuff, live animals and forages, by-products of animal origin;

2) no conflict of interest at persons performing actions of the state control;

3) availability of network of authorized laboratories for carrying out laboratory researches (testing);

4) availability of enough qualified and experienced personnel for effective implementation of actions of the state control;

5) availability and proper condition of appropriate means (tools, equipment, etc.) for ensuring effective implementation by personnel of actions of the state control;

6) action plan availability in case of force majeure and readiness to be effective according to the specified plan in case of such circumstances;

7) compliance of actions of the state control to effective objectives;

8) transparency, impartiality and coordination of actions when implementing actions of the state control at all levels;

9) fulfillment of requirements of the legislation during implementation of actions of the state control.

5. External audit of Gosprodpotrebsluzhby and its territorial authorities is carried out annually according to the decision of the Cabinet of Ministers of Ukraine according to the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals". The international experts in spheres of safety of foodstuff and veterinary medicine can be involved in carrying out external audit.

Internal audit of Gosprodpotrebsluzhby and its territorial authorities is carried out annually according to the decision of the Chairman Gosprodpotrebsluzhby according to the Law of Ukraine "About state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals".

6. In case of receipt in the Cabinet of Ministers of Ukraine of information on results of carrying out audit of Gosprodpotrebsluzhby and its territorial authorities by one of the international inspectors of the European Commission, United States Department of Agriculture (USDA) or competent authorities of other states and/or auditors of World Organization of health protection of animal (MEB) according to the criteria determined in item 4 of this Procedure, the decision on carrying out external audit within this calendar year is not made.

7. During audit the planning system, the organizations and implementation of actions of the state control of safety of foodstuff, is estimated by health and wellbeing of animals, sterns, by-products of animal origin which is used by Gosprodpotrebsluzhboy and its territorial authorities.

By results of carrying out audit the conclusion is constituted.

8. In the conclusion about results of carrying out external audit information on results of research is reflected:

1) structures of Gosprodpotrebsluzhby and its territorial authorities;

2) conditions of accomplishment of long-term and short-term tasks of the state control, including plans of the state monitoring;

3) conditions of accomplishment of tasks and powers by officials of Gosprodpotrebsluzhby, its territorial authorities and authorized persons to which powers concerning implementation of the separate measures of the state control determined by the legislation are conferred by Gosprodpotrebsluzhboy;

4) conditions of observance of procedure for sampling, methods (techniques) of laboratory researches (testing), interpretations of results of such researches (testing) and adoption of further decisions;

5) checks of effectiveness of methods (techniques) of sampling, methods (techniques) of laboratory researches (testing);

6) materials on accomplishment by the operator of the market of the instructions, orders and decisions issued by results of implementation of actions of the state control;

7) efficiency of the state control during production and turnover of live animals, foodstuff and forages, and also at stage of use of forages;

8) efficiency of use of statistical information and methods of its processing in case of acceptance of management decisions;

9) results of import control and export of foodstuff, animals, forages, by-products of animal origin, international certificates for export of the specified products, and also the made decisions for ensuring compliance with the importing country;

10) providing level:

enough personnel, and also training programs and advanced trainings of personnel which perform measures of the state control, and the officials performing actions of the state control;

rooms for accomplishment the assigned to Gosprodpotrebsluzhbu and its territorial authorities of obligations;

communications with the companies, organizations and the organizations, including research, participating in realization of state policy in spheres of safety of foodstuff and veterinary medicine;

vehicles, including specialized, for delivery of samples in authorized laboratories, and also for inspection of capacities, other objects.
