About implementation of the state external borrowings in 2019 by attraction of the credit

For the purpose of accomplishment of the Law of Ukraine "About the Government budget of Ukraine for 2019" the Cabinet of Ministers of Ukraine decides:

1. Perform the state external borrowings in 2019 by attraction of the credit.

2. Approve the Main conditions of implementation of the state external borrowings in 2019 by attraction of the credit which are applied.

3. According to part one of Article 16 of the Budget code of Ukraine to charge to the Deputy Minister of Finance concerning the European integration Heletey Yury Igorevich who at the time of transaction fulfills duties of the Minister of Finance, to perform the state external borrowings in 2019 by attraction of the credit it agrees to the Main conditions approved by this resolution to sign the corresponding credit agreement and to sign other documents connected with attraction of the credit.

3-1. According to part one of Article 16 of the Budget code of Ukraine to charge to the Minister of Finance or the person who fulfills its duties, in case of need to make changes to the credit agreement specified in Item 3 of this resolution which will not have influence on the Main conditions approved by this resolution and to sign other documents connected with attraction of the credit.

4. Provide to the Deputy Minister of Finance concerning the European integration Heletey Yury Igorevich who at the time of transaction fulfills duties of the Minister of Finance, the right of determination final the amounts of each tranche of the credit and rate of interest income on the following tranches in the limits provided by Items 1 and 2 of the Main conditions approved by this resolution.

5. To the Ministry of Finance to provide in time of creation of the draft of the Government budget of Ukraine for the corresponding year of means for repayment and servicing of the state external borrowings performed in connection therewith by the resolution.

The main conditions of implementation of the state external borrowings in 2019 by attraction of the credit

1. The state external borrowings are performed in 2019 by attraction of the loan granted in the form of two trenches: tranche And yes B tranche, for the total amount of euro which does not exceed equivalent of 630 million US dollars, in the limits provided by the Law of Ukraine "About the Government budget of Ukraine for 2019" (further - the credit).

2. On the amount of each tranche of the credit it is charged:

interest income at the rate not above annual interest rate 5,9;

loan origination fee in the amount of percent 0,8.

3. Interest income is paid each half a year according to the schedule which is determined in the credit agreement.

4. Final loan repayment is performed:

concerning A tranche - in four years after its attraction with repayment (depreciation) each half a year according to the schedule which is determined in the credit agreement;

concerning B tranche - in ten years after its attraction.

At the same time the grace period of deferred settlement of tranche B credits constitutes four years and six months after its attraction with the subsequent repayment (depreciation) each half a year according to the schedule which is determined in the credit agreement.

5. Obligations on credit to the amount in euro which does not exceed equivalent of 375 million US dollars are provided with guarantee of the International Bank for Reconstruction and Development according to the credit agreement between Ukraine, the International Bank for Reconstruction and Development, Deutsche Bank AG, London Branch and TMF Global Service (UK) Limited.

6. The payment for rendering the stipulated in Item 5 presents of the Main warranty conditions of the International Bank for Reconstruction and Development is performed according to the Agreement on indemnification signed between Ukraine and the International Bank for Reconstruction and Development (Guarantee for support of state policy in the sphere of economic growth and fiskalno steady services).

7. Repayment and servicing of the credit is performed at the expense of the means provided by the law on the Government budget of Ukraine for the corresponding year.

8. Other conditions of attraction of the credit are determined by the corresponding credit agreement and other documents connected with its attraction.
