According to the order of the Government of the Republic of Kazakhstan of December 29, 2018 No. 936 "About some questions of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan and modification and amendments in some decisions of the Government of the Republic of Kazakhstan" PRIKAZYVAYU:

1. Approve enclosed:

2. Recognize invalid:

1) the order of the Minister of investments and development of the Republic of Kazakhstan of January 31, 2018 No. 63 "About approval of provisions of public institution "Committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan" and its territorial authorities" (it is published on February 7, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in electronic form);

2) the order of the Minister of investments and development of the Republic of Kazakhstan of August 15, 2018 No. 575 "About modification and amendments in the order of the Minister of investments and development of the Republic of Kazakhstan of January 31, 2018 No. 63 "About approval of provisions of public institution "Committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan" and its territorial subdivisions" (it is published on August 24, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in electronic form).

3. To provide to committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan:

1) within ten calendar days from the date of approval of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

5. This order becomes effective from the date of signing.

Provision of republican public institution "Committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan"

Chapter 1. General provisions

1. The republican public institution "Committee of transport of the Ministry of the industry and infrastructure to development of the Republic of Kazakhstan" (further – Committee) is the department of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further – the Ministry) performing regulating, realizable and control and supervising functions within the competence, and also participating in accomplishment of strategic functions of the Ministry in the field of transport, except for air and pipeline.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in Kazakh, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure and limit of the number of staff of Committee affirm according to the legislation of the Republic of Kazakhstan.

8. Committee location: Republic of Kazakhstan, 010000, city of Astana, area Esil, Prospekt Kabangbai of the batyr, 32/1, building "Transport Tower".

9. Full name of Committee:

in state language – "Kazakstan of Respublikasa Industriya of Zhane infrakurylymdyk the lady ministrliginin Kolik komiteti" respublikalyk memlekettik mekemesi;

in Russian – republican public institution "Committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan".

10. This Provision is the constituent document of Committee.

11. Financing of activities of Committee is performed from the republican budget.

12. The committee is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are powers of Committee.

If legal acts grant the right to perform the activities which are bringing in incomes, then income gained from such activities go to the government budget.

Chapter 2. Tasks, rights and obligations of Committee

13. Tasks:

1) participation in forming of state policy in the field of transport, except for air and pipeline and subsequent its realization;

2) creation of conditions for ensuring requirements of economy of the republic and the population in transportations, performance of works and rendering services, and also further development of transportations and infrastructure of transport, except for air and pipeline;

3) protection of the rights and legitimate interests of physical persons and legal entities, and also national interests of the state, and also creation of conditions for competition development, including in the field of international carriages;

4) control of ensuring safe operation and activities on all modes of transport, except for air and pipeline;

5) control of activities, and also of observance of requirements of the legislation by legal entities and physical persons in the field of transport, except for air and pipeline.

14. Rights and obligations:

rights:

1) issues orders within the competence;

Requests 2) and receives (reports, materials) from structural divisions of the Ministry and territorial authorities of Committee, state bodies, the organizations, their officials, physical persons and legal entities, necessary information and materials;

3) makes suggestions for improvement of the legislation of the Republic of Kazakhstan;

4) holds meetings, seminars, conferences, round tables, tenders and other actions for the questions entering competence of Committee;

5) makes offers on creation of advisory advisory bodies (working groups, the commissions, councils) on the supervised activities;

6) involves the corresponding experts to participation in examinations in the questions carried to the competence;

7) takes part in conducting checks of the physical persons and legal entities performing the activities on transport by territorial authorities of Committee;

8) makes offers in state bodies on the prevention of transport incidents, violations of method of operation and content of transport;

9) participates in implementation of transport control of vehicles on posts of transport control;

10) is checked by execution of contractual commitments and adopts acts of the rendered services;

11) uses special technical means of communication, special transport, and also uses staff, whistle and barrier during the work on posts of transport control;

12) demands from territorial authorities of Committee of timely and exact execution of orders and orders of the Ministry and Committee;

13) performs other rights provided by the current legislation of the Republic of Kazakhstan.

Obligations:

1) ensuring realization of the tasks and functions assigned to Committee;

2) compliance with law of the Republic of Kazakhstan, it is right and protected by the law of interests of physical persons and legal entities;

3) preparation of explanations on the questions entering competence of Committee;

4) submission of required materials and references within the competence and within the legislation in case of official request for it by structural divisions of the Ministry and state bodies;

5) ensuring safety of the state-owned property which is on balance of Committee;

6) conducting financial accounting;

7) creation and provision of the accounting and financial reporting in the Ministry;

8) providing complete, timely and effective use of the budgetary funds allocated to Committee;

9) holding procedure of public procurements according to the Law of the Republic of Kazakhstan "About public procurements".

15. Functions:

1) ensuring realization of state policy within the competence;

2) participation in development, coordination and approval of regulatory legal acts within the competence;

3) providing inland waterways in navigable condition and content of locks;

4) development and coordination of technical regulations and standards;

5) maintaining the register of the physical persons and legal entities which submitted the notification on the beginning of implementation of activities for production and issue of electronic cards to electronic (digital) tachographs;

6) maintaining the national database on electronic (digital) tachographs;

7) maintaining the State register of railway vehicles;

8) implementation of allowing control;

9) issue of the certificate on compliance to the requirements established according to the procedure of transportation of goods by road transport of the vehicles registered in the Republic of Kazakhstan, intended for perishable traffic when implementing international carriages;

10) coordination of standard rates of provision of the parcels of land according to project technical documentation and general schemes of development of railway tracks and railway stations;

11) development of checking sheets, criteria for evaluation of degree of risks and forming of lists of selective checks according to the Entrepreneurial code of the Republic of Kazakhstan;

12) acceptance based on international treaties of the Republic of Kazakhstan decisions on recognition of foreign classification society;

13) determination of authorized organization for evaluating protection of port means and plan development of protection of port means;

14) approval of the valuation report of protection of port means and plan of protection of port means and amendments to them;

15) the conclusion of agreements with foreign classification society by determination of powers on survey of courts and conditions of their provision by foreign classification societies;

16) development of rules of the admission of automobile carriers to implementation of the international motor transportations of freights;

17) development of rules of application in the territory of the Republic of Kazakhstan of the international certificate of weighing of cargo vehicles;

18) development of procedure for the organization of work of posts of transport control;

19) development of rules of use of the special automated measuring means;

20) development of method of calculation of rates for rendering services in transportation of passengers and baggage along regular routes;

21) development of rules of rendering services in transportation of persons with disability road transport;

22) development of the standard agreement of the organization of regular motor transportations of passengers and baggage;

23) development of admissible parameters of the vehicles intended for movement on highways of the Republic of Kazakhstan;

24) development of rules of labor organization and rest of drivers, and also use of tachographs;

25) development of rules of transportation of dangerous goods by road transport;

26) development of rules of transportations of passengers and baggage by road transport;

27) development of rules of transportation of goods by road transport;

28) development of rules of technical operation of vehicles;

29) development of rules of application of authorization system of motor transportations in the Republic of Kazakhstan in the international message;

30) development of the list of the dangerous goods allowed to transportation by vehicles in the territory of the Republic of Kazakhstan;

31) development of procedure for the organization and implementation of transportations of bulky and heavy loads in the territory of the Republic of Kazakhstan;

32) development of rules of involvement of carriers to liquidation of emergency situations;

33) development of rules of subsidizing at the expense of budgetary funds of losses of the carriers connected with implementation of socially important transportations of passengers;

34) development of rules of technological interaction of participants of transportation process;

35) development of the list of station ways, objects of electric utility service, the alarm system, communication, devices, the equipment, buildings, structures, constructions and other objects technologically necessary for functioning of the high-level railway system, in coordination with the state body performing management in spheres of natural monopolies;

36) development of procedure and measures of ensuring agreement obligations on the organization of transportations and (or) accomplishment of the services connected with transportation;

37) development of the freight list, subject to maintenance by the militarized protection in transit by rail;

38) development of procedure for rewarding of workers of rail transport with sign of professional difference;

39) development of procedure for provision of services of the freight forwarder;

40) development of procedure for provision of services of operators of cars (containers);

41) development of procedure for provision of services of locomotive draft;

42) development of rules of technical operation of rail transport;

43) development of the list of the transactions entering services of the high-level railway system in coordination with the state body performing management in spheres of natural monopolies;

44) development of the list of classification of railway vehicles, special railway vehicles;

45) development of the instruction for train service and shunting work on rail transport;

46) development of rules of the organization of sale of travel documents (tickets) on rail transport in the Republic of Kazakhstan;

47) development of procedure for accounting and submission of the reporting on transportations of passengers, baggage, cargo baggage, freights and use of railway vehicles when transporting;

48) development of the terms connected with train service;

49) development of procedure and conditions of hitching and running of railway vehicles as a part of passenger trains;

50) development of technical and technological standard expense rates of raw materials and materials, spare parts, the equipment, fuel, energy, technical losses for subjects of natural monopolies on rail transport;

52) development of rules of providing with the militarized protection of freights in transit by rail;
