About approval of the Regulations on certification of appraisers for the purposes of obligatory civil liability insurance of owners of vehicles

1. Approve Regulations on certification of appraisers for the purposes of obligatory civil liability insurance of owners of vehicles it (is applied).

2. Declare invalid the order of the Belarusian bureau on transportation insurance of June 10, 2014 No. 15 of odes "About Approval of the Regulations on Assignment of Qualification Categories to Appraisers and Their Certification for the purposes of Obligatory Civil Liability Insurance of Owners of Vehicles".

3. This order becomes effective since March 1, 2019.

Regulations on certification of appraisers for the purposes of obligatory civil liability insurance of owners of vehicles

1. This Provision establishes procedure and conditions of carrying out certification of appraisers of vehicles (further - TS) and appraisers of other property (except for TS) contractors of assessment, insurers and the Belarusian bureau on transportation insurance (further - the Belarusian bureau) for the purposes of obligatory civil liability insurance of owners of TS.

2. For the purposes of this provision the following levels of professional competence of appraisers are established:

the appraiser-trainee of TS – physical person which has the right to perform independently inspection of TS with limited quantity of the damaged parts and to determine repair price of TS based on the inspection reports which are drawn up by it, and also in the test mode the cost of updating of TS and cost of TS under control of the appraiser of TS;

the appraiser assistant of TS – physical person which has the right to perform independently inspection of TS and other property and to determine repair price of TS;

the appraiser of TS – physical person which has the right to perform inspection of TS and other property, to determine repair price of TS, cost of TS and the extent of the harm done to TS as a result of the road accident;

the appraiser expert of TS – physical person which has the right to perform inspection of TS and other property, to determine repair price of TS, cost of TS, the extent of the harm done to TS as a result of the road accident, to carry out expertize of inspection reports of TS and the conclusions about the extent of the harm done the TS as a result of the road accident constituted by appraisers-trainees of TS, appraisers assistants of TS and appraisers of TS;

the appraiser of property (except for TS) (further – the appraiser of property) – physical person which has the right to perform inspection of property (except for TS), to determine property repair price, property value and the extent of the harm done to property as a result of the road accident.

3. The appraiser-trainee of TS in the course of the activities receives and enhances practical skills of evaluating the extent of the harm done to TS.

For control of activities of the appraiser-trainee of TS and management it the contractor of assessment, the insurer (The Belarusian bureau) determines person from among appraisers of the TS having the level of professional competence is not lower than the appraiser of TS and length of service with the specified level of professional competence at least three years.

The appraiser-trainee of TS has the right to perform the following operations:

analyze documents and initial information for assessment of the extent of the harm done to TS;

conduct independently survey of TS on which there are no more than five foreign visible damages of parts;

perform inspection of any TS under control of the appraiser of the TS determined according to part two of this Item;

determine repair price of TS based on the inspection report of TS which is drawn up by it;

determine in the test mode the cost of updating of TS and cost of TS under control of the appraiser of the TS determined according to part two of this Item.

At the same time the appraiser-trainee of TS shall have the following skills:

reflect technical characteristics of TS, its condition and features in case of creation of the inspection report;

analyze the documents received from the customer of assessment, the victim and other interested persons;

use the software for cost determination of repair of TS;

find, analyze and use information sources for accomplishment of calculations, prove need of their application;

use computer and other auxiliary facilities, communicating device;

draw up inspection reports and calculations of repair price of TS according to the requirements established by the legislation.

4. The appraiser assistant of TS in the course of the activities independently carries out assessment of the extent of the harm done to TS taking into account the restrictions set by this Provision.

The appraiser assistant of TS has the right to perform the following operations:

analyze documents and initial information for assessment of the extent of the harm done to TS;

perform inspection of TS;

perform inspection of property;

determine repair price of TS.

The appraiser assistant of TS has no right to perform the following operations:

determine the cost of updating of parts of TS;

determine the cost of TS;

advise the customer of assessment, the victim, other interested persons concerning determination of the extent of the harm done to TS;
