1. Approve:

1) the Provision of republican public institution "Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan" according to appendix 1 to this order;

2) the Provision of republican public institution "East Kazakhstan interregional department of geology and subsurface use of Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of Vostkaznedr in the city of Ust-Kamenogorsk" according to appendix 2 to this order;

3) the Provision of republican public institution "West Kazakhstan interregional department of geology and subsurface use of Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of Zapkaznedr in the city of Aktobe" according to appendix 3 to this order;

4) the Provision of republican public institution "North Kazakhstan interregional department of geology and subsurface use of Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of Sevkaznedr in the city of Kokshetau" according to appendix 4 to this order;

5) the Provision of republican public institution "Central Kazakhstan interregional department of geology and subsurface use of Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of Tsentrkaznedr in the city of Karaganda" according to appendix 5 to this order;

6) the Provision of republican public institution "Southern Kazakhstan interregional department of geology and subsurface use of Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of Yuzhkaznedr in the city of Almaty" according to appendix 6 to this order.

2. To provide to committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan:

1) within ten calendar days from the date of approval of this order the direction it electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on the Internet - resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective from the date of its signing, except for subitems 44), 45), 59) and 76) of Item 16 of the Provision of Republican public institution "Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan" which are effective till January 1, 2024, and also the subitem 82) of the specified Item which is effective till January 1, 2023 according to the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use".

Provision of republican public institution "Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan"

Chapter 1. General provisions

1. The republican public institution "Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan" (further - Committee) is the department of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the Ministry) performing regulating, realizable and control functions, and also participating in accomplishment of strategic functions of the Ministry in spheres of the state geological studying, reproduction of mineral resources, public administration by subsurface use.

2. The committee has the territorial subdivisions and the organizations which are under its authority according to appendix to the Provision of republican public institution "Committee of geology and subsurface use of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan" (further - the Provision).

3. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The committee is legal entity in form of business of republican public institution, has seals and stamps with the name in state language, forms of the established sample, and also according to the legislation of the account in bodies of treasury.

5. The committee enters the civil relations from own name.

6. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

7. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

13. The committee does not enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of Committee.

Chapter 2. Main objectives, functions, rights and obligations

14. Mission: increase in geological study of the territory of Kazakhstan for the purpose of completion of mineral resources for active development of all industries of the country.

15. Tasks: realization of state policy in the sphere of the state geological studying, reproduction of mineral resources, public administration by subsurface use.

16. Functions:

1) implementation of regulating, realizable and control and supervising functions and participation in accomplishment of strategic functions of the Ministry within competence of department;

2) approval of regulatory legal acts on the questions entering competence of department and with direct competence on their approval of orders of the Minister, except for the regulatory legal acts affecting rights and freedoms of man and citizen;

3) implementation of international cooperation within the competence;

4) ensuring compliance with the laws and other regulatory legal acts of the Republic of Kazakhstan in the field of mobilization preparation and mobilization;

5) management of activities of the subordinated organizations for planning and holding actions for ensuring national security within the competence;

6) ensuring compliance with the laws and other regulatory legal acts in the field of homeland security;

7) the organization of works on development of technical regulations within the competence;

8) organization of activities of the State Commission on Mineral Reserves of the Republic of Kazakhstan;

9) development, coordination with authorized body in the sphere of permissions and notifications of regulatory legal acts on approval of qualification requirements and the list of the documents confirming compliance to them, except for qualification requirements and the list of documents to the licensed types of activity in the sphere of gaming;

10) carrying out the analysis of regulatory impact concerning the drafted draft documents, stipulated in Item 3 articles 82 of the Entrepreneurial code of the Republic of Kazakhstan, according to the procedure, determined by authorized body by entrepreneurship;

11) placement on official Internet resource of the Ministry of result of the carried-out analysis of regulatory impact;

12) implementation of observation and check regarding compliance of activities of the checked subjects to the requirements established by the legislation of the Republic of Kazakhstan according to Item 2 of article 132 of the Entrepreneurial code of the Republic of Kazakhstan;

13) realization of state policy in the field of the state control and supervision in the respective sphere;

14) development within the competence of the regulatory legal acts provided by Items 2 and 3 of Article 141, Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan, and also semi-annual schedules of conducting checks;
