About approval of Rules of creation, work and liquidation of technical committees on standardization

According to the subitem 13) article 9 of the Law of the Republic of Kazakhstan "About standardization" PRIKAZYVAYU:

1. Approve the enclosed Rules of creation, work and liquidation of technical committees on standardization.

2. Recognize invalid the following orders of the acting minister of the industry and new technologies of the Republic of Kazakhstan:

1) of April 23, 2010 No. 42 "About approval of Rules of creation, work and liquidation of technical committees on standardization" (it is registered in the Register of state registration of regulatory legal acts at No. 6276, it is published on September 4, 2010 in the Kazakhstanskaya Pravda newspaper No. 233 (26294);

2) of August 14, 2013 No. 250 "About modification and amendments in the order of the acting minister of the industry and new technologies of the Republic of Kazakhstan of April 23, 2010 No. 42 "About approval of Rules of creation, work and liquidation of technical committees on standardization" (it is registered in the Register of state registration of regulatory legal acts at No. 8650, it is published on December 5, 2013 in the Kazakhstanskaya Pravda newspaper No. 330 (27604).

3. To provide to committee of technical regulation and metrology of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective since April 11, 2019 and is subject to official publication.

Rules of creation, work and liquidation of technical committees on standardization

Chapter 1. General provisions

1. These rules of creation, work and liquidation of technical committees on standardization (further - Rules) are developed according to the subitem 13) of article 9 of the Law of the Republic of Kazakhstan "About standardization" and determine procedure for creation, work and liquidation of technical committees on standardization.

2. Technical committees on standardization (further - shopping mall) are created in economy industries on the basis of the principles of voluntary participation of subjects of national system of standardization for development of national system of standardization in the industry assigned to shopping mall.

Creation of shopping mall based on National authority on standardization is allowed (further - NOS).

3. Creation, activities coordination, liquidation of shopping mall, and also inclusion in the register of national system of standardization is performed by NOS.

4. The interested subjects of national system of standardization in the corresponding industry can be applicants on creation of shopping mall.

5. Representatives of the interested subjects of national system of standardization in the corresponding industry are part of shopping mall.

The shopping mall is also included the representative of NOS as the independent expert-observer for ensuring transparency of work of shopping mall without voting power at meetings of shopping mall.

6. The interested subjects of national system of standardization are part and are excluded from structure of shopping mall based on the application submitted to NOS.

7. The members of shopping mall who are not taking part in activities of shopping mall within two years are removed from structure of shopping mall and replaced with other interested representatives according to the decision of NOS based on the minutes of shopping mall.

8. Information and analytical and organizational support of activities of shopping mall is performed by its basic organization.

9. For the purpose of ensuring activities of shopping mall, conducting correspondence, preparation and document creation of meetings of shopping mall the secretariat which consists of the chairman, his deputy (if necessary), the responsible secretary and the expert with knowledge of foreign language is effective.

10. The secretariat is appointed from the basic organization from among members of shopping mall for the purpose of coordination of activities of shopping mall, conducting correspondence, preparation and document creation. Functions of the chairman of shopping mall and its deputy are determined in ST of RK 1.15 "Technical committees on standardization. Procedure for creation and functioning" (further - the fundamental national standard).

11. The secretariat corresponds on the form of the basic organization or on the form of shopping mall with details of the basic organization.

12. Activities of shopping mall are performed through the information system "Electronic Technical Committees" (further - information system) NOS posted on the official site or by written correspondence.

Operating procedure of shopping mall through information system are established by the fundamental national standard.

Chapter 2. Procedure for creation of technical committee on standardization

13. The shopping mall is created on condition of lack of duplication of subjects of standardization with the operating shopping malls.

14. The request for creation of shopping mall goes to NOS the interested subject of national system of standardization in any form with indication of reasons of need and feasibility of creation of shopping mall, and also the full and abbreviated name of the legal entity based on which creation of shopping mall with the detailed information about its activities and opportunities for creation of operating conditions of shopping mall is offered.

1) the list of the subjects of standardization fixed for shopping mall or sphere of activity of shopping mall;
