About approval of Rules of mutually connection of telecommunication public service networks

According to Items 16, the 19th article 18 of the Law of Ukraine "About telecommunications" and Regulations on the National commission on the questions of regulation of communication of Ukraine approved by the Presidential decree of Ukraine of 21.08.2004 No. 943, the National commission on questions of regulation of communication of Ukraine RESHILA:

1. Approve Rules of mutually connection of telecommunication public service networks (further - Rules) which are attached.

2. Approve Rules with the Antimonopoly Committee, Gospredprinimatelstv and tax on registration in the Ministry of Justice of Ukraine.

3. Post the text Edited on the NKRS official website and to publish in the statement NKRS.

Rules of interaction of telecommunication public service networks

I. General provisions

1.1. These Rules govern the relations of operators of telecommunications which intend to combine or already combined the telecommunication networks with telecommunication networks of other operators of the telecommunications functioning as a part of telecommunication public service network (further - PSTN), irrespective of the technologies applied to information transfer and determine:

procedure for representation, consideration and approval of proposals of operators of telecommunications concerning interaction of telecommunication networks;

mandatory requirements to agreements on interaction of telecommunication networks;

procedure for consideration of addresses, researches of materials, decision on dispute between the parties on the conclusion, change or the agreement cancelation regulating interactions of telecommunication networks and also in case of non receipt of the answer at the scheduled time;

technical, organizational and economic conditions of interaction with telecommunication networks of operators of telecommunications with essential market benefit in the markets of certain telecommunication services (further - operators with IRP);

procedure for determination of economic conditions of interaction with telecommunication networks of operators of telecommunications, settlement dachshunds for access to telecommunication networks, settlement dachshunds for traffic transmission services.

1.2. In these Rules terms are used in the following values:

withdrawal of the offer concerning interaction of telecommunication networks - exception of the proposal of the supplier of points (point) of interaction from the directory of offers concerning interaction of telecommunication networks in connection with:

establishment of mutually connections with complete use of resources (handling capacity) which were provided for the organization of point (points) of interaction;

use of resources which were provided for the organization of point (points) of interaction, for own needs of the supplier;

change of the scheme of creation of telecommunication network of the supplier;

the agreement on interaction - bilateral transaction between operators of telecommunications which subject are the organizational, technical and economic conditions of interaction and other compulsory provisions provided by these rules and the legislation;
