RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of January 30, 2019 No. 56

Some questions of digital development

(as amended on 27-06-2023)

The Cabinet of Ministers of Ukraine decides:

1. Approve bases of realization by executive bodies of the principles of state policy of digital development which are applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. To the ministries, other central executive bodies, regional, Kiev and Sevastopol city public administrations:

within one month from the date of entry into force of this resolution to bring own acts into accord with this resolution and to consider the possibility of creation and ensuring functioning of structural divisions (specialists) concerning digital development, digital transformations and digitalization within the extreme number of workers of the office of the ministries, other central executive bodies, regional, Kiev and Sevastopol city public administrations;

within three months from the date of entry into force of this resolution to prepare offers on introduction of amendments to acts of the legislation, in particular in the field of archiving and clerical work and to provide them to the State agency concerning electronic control for generalization.

3-1. To the central executive bodies (except the ministries) to provide position of the deputy manager of the central executive body concerning digital development, digital transformations and digitalization (CDTO) during preparation of representations to the Cabinet of Ministers of Ukraine about determination of number of deputy managers of relevant organs.

3-2. Determine that deputy managers of the central executive bodies, the regional, Kiev and Sevastopol city public administrations concerning digital development, digital transformations and digitalization (CDTO) receive the necessary methodical assistance and perform the corresponding interaction with the Ministry of digital transformation.

4. To the ministry of digital transformation to perform monitoring and methodical ensuring introduction by executive bodies of the principles of state policy of digital development.

5. Recommend to state bodies and local government bodies:

adhere to the principles approved by Item 1 of this resolution;

consider the possibility of creation and ensuring functioning of structural divisions (specialists) concerning digital development, digital transformations and digitalization and assignment in the procedure for deputy managers of relevant organs established by the legislation concerning digital development, digital transformations and digitalization (CDTO);

bring own acts into accord with this resolution.

6. This resolution becomes effective from the date of its publication, except Items 1, of 4 and 6 changes approved by this resolution which become effective in two months from the date of publication of this resolution.

Bases of realization by executive bodies of the principles of state policy of digital development

1. These bases determine the principles of realization by executive bodies of state policy of digital development.

2. Use of the principles of state policy of digital development in case of realization of the rights and freedoms of citizens is provided with executive bodies in the course of preparation of drafts of new regulatory legal acts or modification of regulatory legal acts and realization of powers of authority by use of digital technologies.

3. Realization of state policy of development digital is based on the principles:

opennesses - consists in ensuring open access to departmental data (information) if other is not established by the legislation;

transparency - consists in possibility of use of public external interfaces to departmental information systems, including the application programming interfaces;

reusability of use - consists in ensuring open interdepartmental exchange of decisions and their reuse;

technological neutrality and portability of data - consists in ensuring access to departmental services and data and reuse irrespective of technologies or their products;

focus on citizens - consists in ensuring first-priority accounting of needs and expectationses of citizens in case of decision making concerning forms or methods of implementation of functions of the state;

inclusivity and availability - consists in possibility for all citizens to use the latest developments of information technologies of access to services;

safety and confidentiality - consists in providing for citizens and subjects of managing of the safe and reliable circle in which there is electronic interaction to the state, including its full compliance to the rules and requirements established by the laws of Ukraine concerning the personal data protection and information belonging to the state, electronic identification and confidential services;

multilingualism - consists in ensuring provision to citizens and subjects of managing of administrative, information and other services, including cross-border, with use of language at their choice;

decision supports - consists in ensuring use of the latest information technologies for development of software products which support decision making by executive bodies in case of realization of powers of authority;

administrative simplification - consists in ensuring acceleration and simplification of administrative processes by their digital development;

preserving information - consists in ensuring storage of decisions, information, records and data, reliability and integrity, and also their availability according to security policy and confidentiality during certain time;

efficiency evaluation and effectiveness - at least two alternative decisions for ensuring efficiency and effectiveness of realization of powers of authority consist in carrying out comprehensive estimation and comparison.

1.
