According to part two of Article 95 of the Economic Procedure Code of Ukraine, part two of Article 99 of the Code of civil procedure of Ukraine, part two of article 98 of the Code of administrative legal proceedings of Ukraine the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for transfer by court of the ware proofs which are objects which are withdrawn from civil circulation or it is limited are transferable it (is applied).

Procedure for transfer of physical evidences by court which are objects which are withdrawn from civil circulation or it is limited are transferable

1. This Procedure determines the mechanism of transfer of ware proofs by court if they are withdrawn from civil circulation or is limited are transferable (further - proofs), to the companies, organizations or the organizations which have the right to implementation of actions for the further address with such objects (further - the companies), and also the public expert institutions for use in expert and scientific work.

2. Transfer of proofs is performed based on the judgment with execution of the delivery-acceptance certificate in form according to appendix in triplicate. One copy of the act remains in legal case, one - in nomenclature case of court, and one copy with the copy of the judgment attached to it is transferred to the company or the public expert institution.

3. For ensuring transfer of proofs the commission which structure joins representatives of court (the office of court) and the company or the public expert institution is created. Members of the commission are appointed by the relevant orders by the chairman of justices and the director or the public expert institution. Commission chairman is the representative of court (the office of court) from among members of the commission.

4. The delivery-acceptance certificate of proofs is signed by the chairman and members of the commission.

5. Proofs are transferred to the company in day of signing of the delivery-acceptance certificate.
