Cabinet of Ministers of Ukraine decides:

Approve the Procedure for provision of services on temporary placement (accommodation) which is applied.

Procedure for provision of services on temporary placement (accommodation)

1. This Procedure regulates questions of provision by legal entities and physical persons of services in temporary placement (accommodation).

2. Hotels and other objects intended for provision of services on temporary placement (accommodation) (further - means of placement), share on:

collective - means of placement by total quantity of places 30 or more in which provide the place for spending the night in the room or other room and for which the payment on stated prices is levied;

individual - housing in which the limited number of places (less than 30) is for a fee or free of charge provided. In such means of unit of placement (rooms, housing) shall be separated one one.

3. Services in temporary placement (accommodation) is activities of legal entity and physical person for provision of the place for lodging for the night in means of placement for a fee, and also other activities connected with temporary placement (accommodation), provided by the law.

4. Do not treat services in temporary placement (accommodation):

accommodation of the workers by the legal entity in means of placement which belongs to it;

accommodation of persons with whom the contract on hiring of housing for term which exceeds one month is signed (for resorts term is determined by local executive bodies);

accommodation of persons who study in educational institution, in means of placement which belongs to this institution;

free accommodation of members of the family by physical person or other persons.

5. Legal entities and physical persons - subjects of business activity which provide services in temporary placement (accommodation) in collective means of placement shall provide timely complete and reliable information about documents by which they are guided during provision of services, the list of services, their cost and conditions of obtaining, the rule of effective and safe use of means of placement, the name and the address of the contractor of services, addresses and phone numbers of bodies which provide the state consumer protection.

6. Physical persons - owners or lessees of collective means of placement provide services in temporary placement (accommodation) on condition of state registration them as subjects of business activity.

7. Physical persons - owners or lessees of individual means of placement provide services in temporary placement (accommodation) without state registration them as subjects of business activity.

Physical persons - owners or lessees of individual means of placement shall submit to the time determined by the legislation to body of the relevant Tax Service the declaration in the established form of income gained from provision of such services keep the book of registration in which the surname, name and middle name of the inhabitant, year of birth, the residence (stay) and the document who assures the personality, date of arrival and departure, the cost of the provided services is entered. Statistical data move in local executive bodies in the form established by them.

8. No. 830 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 05.09.2012  

9. The payment for the provided services in temporary placement (accommodation) is levied for the 12th hour of the current days local time.

10. Types and characteristic signs of means of placement, the instruction for use are determined by them MKT.

11. The state classification of funds of placement for compliance of certain category is carried out according to the legislation.

12. For carrying out the state statistical observations legal entities and physical persons - subjects of business activity which provide services in temporary placement (accommodation) in collective means of placement constitute the report according to the legislation.

In the sphere of provision of services on temporary placement (accommodation) develops samples of document forms of primary accounting and approves MKT.

13. Responsibility for provision to consumers of reliable information concerning services in temporary placement (accommodation) and their quality is born by legal entities and physical persons which provide these services, according to the law.
