About some measures for consumer protection

According to article 2 of the Law of the Republic of Belarus of June 13, 2018 "About modification and amendments in the Law of the Republic of Belarus "About consumer protection" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve enclosed:

Regulations on procedure for informing consumers on temporary prolongation or suspension of work of the shopping facility (object of servicing), the seller (contractor) performing trade (performing works, rendering services) without (out of) the shopping facility (object of servicing);

Regulations on procedure and sales terms of goods (performance of works, rendering services) according to the gift certificate or other similar document.

2. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. in the resolution of Council of Ministers of the Republic of Belarus of June 14, 2002 No. 778 "About measures for implementation of the Law of the Republic of Belarus "About consumer protection" (The national register of legal acts of the Republic of Belarus, 2002, No. 71, 5/10637; 2009, No. 31, 5/29207; 2010, No. 132, 5/31898; National legal Internet portal of the Republic of Belarus, 27.12.2013, 5/38196):

the fourth and fifth Item 1 to state paragraphs in the following edition:

"The inventory (results of works) of long-term use, including components and components of the main product which after certain term can pose hazard to life, health, heredity, property of the consumer and the environment which service life the manufacturer shall establish (the contractor, the supplier, the representative);

in Regulations on the procedure for provision to the consumer for repair or replacement of consumer durables gratuitously in temporary use of similar goods approved by this resolution:

state Item 2 in the following edition:

"2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About consumer protection" and also the following terms and their determinations are applied:

similar goods - goods which according to the main characteristics, functional purpose are similar to the goods transferred by the consumer to the manufacturer (seller) for non-paid remedial action in the consumer durables belonging to it or replacements of such goods. At the same time in similar goods distinctions in the name of the manufacturer, the trademark, appearance, the size are allowed;

substitution fund - the consumer durables intended for non-paid provision to the consumer in temporary use (for non-paid elimination according to its requirement of shortcomings of the consumer durables belonging to it or replacement of such goods).";

the second Item 5 to add part with the offer of the following content: "In case of origin between the consumer and the seller (the manufacturer, the supplier, the representative) of dispute on availability of lack of consumer durables and the reasons of its origin the manufacturer (seller) fulfills the requirement about provision to the consumer in temporary use (for repair or replacement) similar goods from substitution fund without delay after conducting examination if examination establishes availability of lack of goods.";

The inventory of long-term use, for remedial action or replacement of which to the consumer gratuitously is not provided to be reworded as follows the similar goods approved by this resolution (is attached);

The inventory of long-term use, including components and components of the main product which after certain term can pose hazard to life, health, heredity, property of the consumer and the environment which service life the manufacturer approved by this resolution shall establish, be reworded as follows (is attached);

The list technically of difficult goods in case of which detection of essential shortcomings (fundamental breach of requirements to their quality) the consumer has the right to require their replacement, approved by this resolution, to be reworded as follows (is attached);

To be reworded as follows the list of the nonfoods of proper quality which are not subject to exchange and return, approved by this resolution it (is applied);

2.2. in Rules of consumer services of the consumers approved by the resolution of Council of Ministers of the Republic of Belarus of December 14, 2004 No. 1590 (The national register of legal acts of the Republic of Belarus, 2005, No. 1, 5/15304; National legal Internet portal of the Republic of Belarus, 10.04. 2015, 5/40364; 24:05. 2016, 5/42093):

in Item 2:

paragraphs two and the thirteenth to exclude;

the third or twelfth and fourteenth or nineteenth to consider paragraphs respectively paragraphs the second or eleventh and twelfth or seventeenth;

2.3. in the resolution of Council of Ministers of the Republic of Belarus of April 7, 2006 No. 471 "About approval of Rules of hotel servicing in the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2006, No. 59, 5/22163):

in word preamble "Article 38" shall be replaced with words "Article 39";

in the Rules of hotel servicing in the Republic of Belarus approved by this resolution:

in Item 2:

in the paragraph the second shall be replaced with words words of "technical regulatory legal acts" "technical regulatory legal acts, obligatory for observance";

to exclude from the paragraph of the fifth word "its branch located out of the location of the legal entity and also";

to state paragraph two of Item 3 in the following edition:
